BREAKING | Batla House Demolition Case Reaches Supreme Court | CJI Gavai: "Hearing Will Be Held Next Week"

NEW DELHI: The Batla House demolition case today reached the Supreme Court of India, and the matter is scheduled for a hearing next week.

A petition has been filed in the Supreme Court against the demolition notice issued for houses and shops located in Khasra number 277 and 279 in the Batla House area of South Delhi.

The petitioner placed the matter before Chief Justice of India (CJI) BR Gavai and requested a quick hearing. When the petitioner’s lawyer raised concerns, he mentioned that the Supreme Court had earlier stated that a 15-day notice must be given before any demolition, but this time, a notice was just pasted without a hearing.

“The Supreme Court had said that a 15-day notice is needed, but here a notice has been pasted and it has been said that we should vacate. The notice was pasted on May 26, we were not heard.”

At first, CJI BR Gavai asked why the petitioner did not approach the High Court. But the petitioner reminded the bench that the Supreme Court itself had passed an order in this matter earlier, which makes it a fit case for them to approach the apex court.

“The Supreme Court had issued an order regarding the demolition. The hearing will be held next week.”

The petitioner also argued that the Delhi Development Authority (DDA) is not following the rules set by the Supreme Court itself in this matter. According to the DDA, Khasra number 279 is their property and the houses on it have been built illegally.

However, the petitioner pointed out that the Supreme Court’s earlier order was only about Khasra number 279, but the DDA has now issued notices for Khasra numbers 281 to 285 as well.

“The guidelines made by the Supreme Court have not been followed.”

Meanwhile, a separate eviction notice has been issued by the Uttar Pradesh Irrigation Department. This department claims that Khasra number 277 in Okhla village, South Delhi, is their land and has been illegally occupied for the last 50 to 60 years. Houses and shops have been constructed illegally on this land along Muradi Road and Sailing Club Road.

A notice has been pasted on these homes and shops ordering people to vacate by June 5, 2025.

“This notice has been issued against illegal constructions made on Khasra number-277. These shops and houses have been ordered to be vacated by June 5.”

The local residents who have been living in these homes and running their businesses for decades are upset and angry. They say they will not leave under any circumstances and are ready to fight for their homes.

“No matter what happens, we will not vacate it. We will fight and die but will not leave this place.”

The Supreme Court’s hearing next week will be crucial for hundreds of families and shopkeepers whose homes and businesses are now under threat. As the legal battle intensifies, all eyes are now on the apex court to see what decision it takes in this sensitive and long-standing matter.
