NEW DELHI: The Supreme Court of India has issued notice in a case concerning an AI-generated video posted on X by the Assam unit of the Bharatiya Janata Party (BJP). The video, according to the petitioners, portrays a “Muslim takeover” of Assam if the BJP does not remain in power, raising concerns over communal disharmony and the undermining of secular values enshrined in the Indian Constitution.

Background of the Case

The petition, filed under Writ Petition (No. 24/2022) by advocate Lzafeer Ahmad on behalf of the applicants, claims that the video circulated on September 15, 2025, depicts visibly Muslim individuals taking over key landmarks in Assam, including tea estates, Guwahati airport, Rang Ghar, and government lands. The petition argues that the content vilifies Muslims, spreads communal fear, and attempts to influence voters by portraying a scenario of a “takeover” if the BJP loses elections.

The video reportedly gained views online, being viewed over 4.6 million times, liked 19,000 times, and reposted 6,100 times as of September 18, 2025. The petitioners have sought immediate removal of the video to prevent further communal tension and have also urged the Court to direct X India Pvt. Ltd. and BJP Assam Pradesh to act.

Legal Arguments

The petition emphasizes the constitutional responsibilities of an elected government. It asserts that:

  • As the ruling party in Assam, BJP-Assam is constitutionally obligated to uphold secular values and cannot circulate divisive or communal content.
  • A state government is the guardian of all communities and is prohibited from discriminating based on religion, caste, race, gender, or language.
  • Even private citizens are legally restricted from making communal speeches or spreading content that may incite hatred or unrest.

The petition contends that the AI-generated video attacks Muslims and attempts to create fear among the electorate, essentially equating a Muslim-led scenario with a “worst-case outcome,” thereby seeking votes through communal narratives.

Supreme Court Proceedings

A Bench comprising Justices Vikram Nath and Sandeep Mehta issued notice after hearing the arguments presented by advocate Nizam Pasha, who represented the applicants. The Court has posted the matter for further hearing on October 27, 2025.
