New Delhi: The Supreme Court of India delivered a significant ruling, dismissing a series of review petitions challenging its previous verdict that upheld the abrogation of Jammu and Kashmir’s special status under Article 370 of the Constitution.

A five-judge constitutional bench, headed by Chief Justice D.Y. Chandrachud, unanimously rejected the review pleas, stating that there was no apparent error in the court’s judgment delivered on December 11, 2023.

The bench, comprising Justices Sanjiv Khanna, B.R. Gavai, Surya Kant, and A.S. Bopanna, thoroughly examined the review petitions and found no merit in the arguments presented by the petitioners, who sought a reconsideration of the court’s earlier decision.

The apex court’s ruling effectively affirms the constitutional validity of the Central government‘s move to revoke Jammu and Kashmir’s special status and bifurcate the erstwhile state into two Union Territories Jammu and Kashmir, and Ladakh.

In its landmark judgment last year, the Supreme Court upheld the abrogation of Article 370, which had granted semi-autonomous status to Jammu and Kashmir, and the subsequent reorganization of the region.

The court ruled that the Parliament possessed the legislative competence to enact the necessary laws and that the abrogation did not violate the Constitution’s basic structure. The review petitions filed by various individuals, political parties, and civil society groups, who had argued that the court’s verdict failed to address critical constitutional issues and had departed from established legal principles.

The Supreme Court’s affirmation of the abrogation of Article 370 marks a significant milestone in India’s constitutional and political landscape. While it closes a chapter on a contentious legal debate, the social, political, and economic repercussions of this decision will likely unfold in the years to come.
