Ancestral Property Case: Supreme Court Stays High Court Order, Big Relief for Saif Ali Khan

Today, On 8th August, Supreme Court stays Madhya Pradesh High Court order in ancestral property dispute involving Nawab Hamidullah Khan’s estate, giving major relief to Saif Ali Khan and family. The case will be reconsidered after the Court issued a notice on the petition.

Mumbai: The Supreme Court provided significant relief to Bollywood actor Saif Ali Khan and his family in a dispute over property linked to Nawab Hamidullah Khan of Bhopal.

The Court has stayed the High Court’s ruling and issued a notice regarding the case. This dispute revolves around the inheritance and division of the Nawab’s estate, with the Patodi family asserting their claims to the heritage.

The Supreme Court, On Friday, reviewed a petition that contested the Madhya Pradesh High Court’s directive to return the case concerning Nawab Hamidullah Khan’s private property to a lower court for a new hearing.

Following this review, the Supreme Court suspended the High Court’s order.

Earlier in July, the High Court had set-aside a lower court’s ruling that recognized Saif Ali Khan, along with his sisters Soha and Saba, and their mother Sharmila Tagore, as the heirs to the estate.

Subsequently, Saif Ali Khan’s family appealed this decision in the Supreme Court.

A bench consisting of Justices P.S. Narasimha and Atul Chandurkar issued a stay on the High Court’s order and provided a notice.

The Patodi family submitted a petition to the Supreme Court seeking the reinstatement of their exclusive inheritance rights over various royal properties in Madhya Pradesh, which are valued at approximately Rs. 15,000 crores. T

he trial court had recognized Saif Ali Khan, his mother Sharmila Tagore, and his sisters as the rightful owners of these properties, but the High Court nullified that ruling.

The High Court also instructed the trial court to conduct a new hearing and resolve the matter within a year.

The case pertains to Nawab Hamidullah Khan, the last ruler of Bhopal. Among his three daughters, one named Sajida married Iftikhar Ali Khan Patodi, while his son Mansoor Ali Khan Patodi was married to Sharmila Tagore.

Mansoor Ali Khan Patodi was also a former captain of the Indian cricket team.

After the eldest daughter of Nawab Hamidullah, Abida, relocated to Pakistan, Sajida became the owner of the properties. Two appeals were filed in court regarding the property dispute; the first by Begum Suraiya Rashid and the second by Nawab Mehr Taj Sajid Sultan.

Following the trial court’s decision, the appellants deemed the ruling unjust, arguing that the property division should adhere to Muslim personal law.
