“Air Has Become Hazardous”: Supreme Court Slams Rising Delhi-NCR Pollution, Seeks Punjab & Haryana Response

The Supreme Court took note of Delhi-NCR’s worsening air quality as AQI crossed 450 in several areas. CJI B.R. Gavai directed Punjab and Haryana to explain steps to curb stubble burning amid “hazardous” pollution levels.

New Delhi: The Supreme Court of India on Wednesday took serious note of the rising air pollution in Delhi-NCR as the Air Quality Index (AQI) continues to remain in the “severe” category across the region.

The Bench, headed by Chief Justice of India B.R. Gavai, was hearing the matter concerning the worsening air quality and the measures being taken by different state governments to tackle the crisis.

During the hearing, Senior Advocate Gopal Sankarnarayanan pointed out that the Graded Response Action Plan (GRAP) Stage III has already been implemented, but the situation now requires the immediate enforcement of Stage IV measures.

He highlighted that the AQI levels have “crossed 450 in several areas”, indicating a dangerous level of pollution.

He further mentioned that despite the alarming situation,

“there is drilling and excavation work happening right outside Court 10,”

and urged that such construction activities

“should at least be stopped within court premises.”

Responding to the submissions, CJI B.R. Gavai directed the Governments of Punjab and Haryana to explain the steps they have taken to prevent stubble burning, which is one of the major causes of pollution in Delhi and surrounding areas during this time of the year.

The Chief Justice said,

“Let the Governments of Punjab and Haryana file their responses on the measures taken to curb stubble burning.”

Meanwhile, the Amicus Curiae assisting the court emphasized that the situation has become extremely dangerous for public health.

He stated,

“The situation has become hazardous. The monitoring mechanism also needs scrutiny – false data appears to be getting uploaded.”

Taking note of the submissions, the Chief Justice assured that the matter would be taken up again soon.

“List the matter on Monday. We will also inform the court staff about this informally,”

said CJI Gavai, signaling that the issue will continue to receive urgent attention.
