The Supreme Court has upheld the CJI’s order staying the investigation into the arrest of advocate Vikram Singh in a Gurugram murder case. The Bench will revisit the matter after reviewing submissions from all parties.

Earlier, the Court had directed that Singh be released on bail without delay, citing concerns over the manner of his arrest.
The matter came up before a Bench of Justices B.R. Gavai and K. Vinod Chandran, which reviewed the latest submissions from Singh and the prosecution.
During the hearing, Vikram Singh urged the Court to call for a status report from the CBI before considering any further steps, including the possibility of discharge.
“I’m not even pressing for discharge right now. Let a status report be called from the CBI first. After that, if the Bench feels discharge is appropriate, so be it. But the prosecution’s conduct in this case is outrageous,”
Singh told the Bench.
Counsel for the prosecution contended that Singh was not summoned in his capacity as a lawyer.
Singh refuted this, pointing the Bench to the memo issued to him.
“Please look at the memo, he was called as a lawyer,”
Singh insisted, asserting that his professional role had been disregarded by the investigating authorities.
At an earlier stage of the hearing, the Chief Justice of India (CJI) had already stayed the investigation against the petitioner, offering critical interim protection.
The Bench reaffirmed that position, noting that the investigation will remain stayed until further orders. After considering the arguments, the Bench decided to take up the case again on a later date.
Earlier, on 19 October, the Supreme Court sharply questioned the Gurugram STF over allegations that advocate Vikram Singh was tortured in custody and released only the next afternoon despite the Court’s clear order for immediate bail. Senior advocate Vikas Singh claimed the advocate was tied to a pole overnight, subjected to third-degree torture, and falsely implicated based on a coerced statement from a co-accused.
CJI B.R. Gavai pressed the State on why the order was not implemented and reminded that every accused, even an alleged gangster, is entitled to legal representation. With the allegations deemed serious, the Court directed the State to file its reply on the request to transfer the investigation to the CBI, granting one additional day to do so.
Earlier Supreme Court Order
In an earlier hearing, the Supreme Court had granted interim protection to the Delhi-based advocate after he alleged that officers of the Gurugram STF unlawfully detained and coerced him for representing clients facing criminal charges. A Bench led by CJI BR Gavai issued notice and directed that the advocate be released forthwith upon furnishing a bail bond of ₹10,000.
The Court noted that the petitioner was a practicing advocate, unlikely to abscond, and that he had alleged custodial intimidation and arrest without being informed of the grounds, raising concerns under Articles 21 and 22 of the Constitution.
The Bench also took note of the petitioner’s claim that his arrest was retaliation for filing an application before a trial court concerning an alleged custodial assault on one of his clients. Finding the allegations serious, the Court allowed dasti service of notice.
