[BREAKING] Kejriwal in Jail | AAP to Move Supreme Court Against Stay on Bail by Delhi HC

Today, On 25th June, AAP plans to appeal to the Supreme Court against the stay on bail for CM Kejriwal in the excise policy case. Justice Sudhir Kumar Jain’s vacation bench criticized the trial court for not properly considering the Enforcement Directorate’s evidence. The bench stated that the court failed to adequately evaluate the material presented. AAP seeks to challenge this decision in the highest court.

New Delhi: The Aam Aadmi Party (AAP) announced on Tuesday its disagreement with the Delhi High Court‘s decision to stay the bail previously granted to Chief Minister Arvind Kejriwal by the trial court. AAP plans to challenge this order in the Supreme Court.

On June 20, the trial court granted Kejriwal bail in a money laundering case linked to the alleged Delhi excise policy scam, ordering his release on a personal bond of Rs 1 lakh.

The High Court stayed the trial court’s order, On Tuesday.

A vacation bench led by Justice Sudhir Kumar Jain noted that the trial court did not adequately consider the evidence presented by the Enforcement Directorate and failed to apply proper judicial scrutiny when deciding on the AAP leader’s bail request.

The judge also mentioned that the trial court should have allowed the agency sufficient opportunity to present its case.

In response to the ruling, the AAP announced their intention to escalate the matter to the Supreme Court.

The party stated,

“We disagree with the Delhi High Court’s decision. We will contest it in the Supreme Court,”

During a press conference, Delhi cabinet minister Saurabh Bharadwaj addressed the high court‘s decision, indicating that the AAP’s legal team would determine the next steps.

“A high court bench stopped the lower court’s order even before it was officially documented. I had no expectations from the high court.”

He remarked,

“I believe the high court bench was biased. We will take this to a higher court. Our legal team will plan the strategy and timing for approaching the higher court,”

After the trial court granted bail to Kejriwal, the Enforcement Directorate (ED) approached the high court the following day, arguing that the trial court’s decision “perverse,” “one-sided,” and “incorrect,” with conclusions drawn from irrelevant information.

The Delhi excise policy revoked in 2022 following an order from the lieutenant governor, prompting a Central Bureau of Investigation (CBI) inquiry into alleged irregularities and corruption in its creation and implementation.

According to the CBI and the ED, irregularities in the modification of the excise policy, and undue favours were granted to the license holders.
