The complaint, lodged by a city-based lawyer, accuses them of violating judicial confidentiality and seeks to address the dissemination of sensitive information pertaining to ongoing legal cases

NEW DELHI: Today (6th April): A lawyer filed a complaint against Sunita Kejriwal and several other leaders for allegedly sharing court proceedings on social media. The complaint was lodged with the District Judge (Headquarters), seeking an inquiry into the matter and appropriate action against the individuals involved.

Background

The complainant, Vaibhav Singh, claims that the virtual hearing recordings were shared on social media platforms by Sunita Kejriwal and other political leaders. He has also issued a legal notice to social media platforms, requesting the removal of the video related to the court proceedings.

Singh asked for a detailed investigation into the incident and the enforcement of appropriate actions against all individuals and political parties involved. He accuses them of willfully and deliberately disobeying the Video Conferencing Rules dated October 26, 2021, which were established to regulate the use of video conferencing in court proceedings.

The complaint specifically names Sunita Kejriwal, Akshay (whose handle name is @Akshay), Promila Gupta (Councillor, Ward 11, Timarpur), Vineeta Jain (Vice President of INC Rajasthan), and Dr. Arunesh Kumar Yadav (whose handle name is @YadavArunesh). These individuals are accused of unauthorized circulation of video and audio recordings of the court proceedings that took place on March 28, before Special Judge Kaveri Baweja.

According to the complaint, on March 28, 2024, Chief Minister Arvind Kejriwal appeared before the CBI Court in the Delhi Excise Policy case, following his production by the Enforcement Directorate (ED). He chose to present his case personally before the learned special judge, narrating his story and presenting the relevant facts. The recording of his presentation, which lasted around 9 to 9:30 minutes, was widely circulated on various social media platforms.

Singh alleges that members of the Aam Aadmi Party and other opposition parties intentionally and deliberately circulated the audio and video recordings of the court proceedings on social media platforms. He claims that this was done with the intention to malign and manipulate the court proceedings, as well as to mislead the general public and create a perception that the judiciary operates under the influence and pressure of the government.

The complainant asserts that these circumstances indicate a preplanned conspiracy initiated by Arvind Kejriwal and his party members to record the court proceedings. He also highlights the fact that Kejriwal never presented his case before or after March 28, suggesting that his appearance on that particular day was part of a scheme to gain public sentiment.

Furthermore, it is alleged that numerous social media handles belonging to Aam Aadmi Party members and other political parties shared and reshared the audio and video recordings of the court proceedings immediately after the hearing concluded. Sunita Kejriwal, in particular, is accused of reposting the audio recordings, despite the prohibition on recording court proceedings under the High Court of Delhi Rules for Video Conferencing for Courts 2021.

Similarly, Promila Gupta, a former member of the Delhi Commission for Women and the Governing Body of SPM College, allegedly posted the video and audio recordings of the court proceedings.
