“Courtroom Decorum is Non-Negotiable”: Unparliamentary Remarks Leave Court Unable to Hear Bail Plea

A Delhi court has rejected a bail application for Aman, charged with attempted murder, due to disruptive behavior from his father during hearings. The judge cited “unparliamentary language” and persistent interruptions as reasons for halting proceedings. This incident emphasizes the necessity of decorum in court to maintain justice and the integrity of legal processes.

New Delhi: A local court in Delhi has declined to hear a bail application, citing the “unparliamentary language” and disruptive behavior of the applicant’s father during proceedings. The case revolves around Aman, who faces charges under Section 307 (attempt to murder) and Section 34 (common intention) of the Indian Penal Code (IPC), as per an FIR registered at the Baba Haridass police station on October 1, 2023.

Additional Sessions Judge Gurmohina Kaur, presiding over the bail plea, noted that Aman’s father continuously disrupted the court with “unparliamentary language” and derogatory remarks aimed at undermining the court’s authority. Despite repeated warnings and requests to maintain decorum, his behavior persisted.

“The father of the applicant or accused is using unparliamentary language and is trying to demean the court. Despite warnings, he is continuously raising his voice and using language uncalled for,”

the judge remarked in the proceedings.

During the hearing held on November 11, Aman’s legal counsel attended via video conferencing, while his father was physically present in court. While the counsel apologized for the father’s behavior, the judge noted that the applicant’s father remained undeterred and continued to make derogatory comments, even after being repeatedly cautioned.

“The court gives a patient hearing to the applicant’s father whenever he appears before the court and requests to mind his conduct. However, the father repeatedly keeps shouting,”

the judge observed.

Citing the father’s behavior as a barrier to conducting the proceedings fairly, the court decided not to proceed with the bail matter. “This court does not deem fit to try the matter as per law,” the judge stated. The case has now been referred to the Principal District and Sessions Judge, South-West District, for further orders.

The incident underscores the importance of maintaining decorum in court proceedings, as disruptive behavior can hinder the administration of justice. Judges are bound by law to ensure a fair trial, and repeated instances of misconduct can lead to delays or even reassignment of cases, as seen in this instance.
