The judge will also determine whether Rashid’s case should be moved to the designated MP/MLA court. Rashid serves as the MP for Baramulla. The judge had previously reserved the bail order, indicating that he would first assess issues of jurisdiction and the potential transfer of the case to a special court.
Rashid surrendered to Tihar jail authorities on October 28, following the expiration of his interim bail. On September 10, the court granted him interim bail to allow him to campaign for the Jammu and Kashmir assembly elections and later extended it until October 28 due to his father’s poor health, with no opposition from the National Investigation Agency (NIA) after verifying the relevant documents.
