[Swati Maliwal Assault Case] 'Larger Conspiracy Behind This': Judicial Custody of Bibhav Kumar Extended Till September 13

NEW DELHI: The Tis Hazari court in Delhi has extended the judicial custody of Bibhav Kumar, a close aide of Delhi Chief Minister Arvind Kejriwal, until September 13 in connection with the Swati Maliwal assault case.

Additionally, the court has requested a response regarding Kumar’s application, which seeks an order for the pagination of the charge sheet and related documents.

This request aims to ensure that Kumar can accurately identify any missing or illegible documents.

In a related development, the Delhi Police informed the Supreme Court on Friday of a suspected larger conspiracy behind the “brutal assault” on AAP’s Rajya Sabha MP Swati Maliwal, which allegedly took place at the official residence of the Chief Minister’s aide.

The police’s claims suggest that the incident may have broader implications beyond the immediate case.

Yesterday in Apex Court

The Delhi Police told the Supreme Court that investigation into the alleged assault on AAP Rajya Sabha MP Swati Maliwal at CM Arvind Kejriwal’s residence “has brought out the fact that” the accused Bibhav Kumar

“and the CM, Delhi, were together at the scene of the crime immediately after the commission of the crime for a significant period of time”.

In its counter affidavit opposing Kumar’s bail plea, the police said that

“the contrarian public stands taken by responsible public servants in the following days also needs to be examined…to decipher if there was a larger conspiracy behind the brutal assault on the complainant/victim.”

The police said,

“Selective footages were leaked to the media before the relevant recording devices could be seized. This act also needs to be examined to find out whether the crime was conspiratorial or otherwise. Therefore, there is still an apprehension that petitioner herein may influence the witnesses or tamper with the evidence.”


Kumar had approached the SC challenging the Delhi High Court order rejecting his bail plea.

Countering Kumar’s petition, the Delhi Police said the scene of the crime being the Delhi CM residence,

“has had a grave impact on the minds of general public and any adjudication…will have cascading effect on the minds of general public…”

The affidavit stated that

“the present case requires the complainant to be heard as any liberty granted to the accused…directly affects her safety and well being and also of her family members”.

It said that some of the submissions by Kumar were

“intended solely to portray the victim in a negative light”.

Police said it had investigated the complaint filed by Kumar against Maliwal for unauthorised entry and creating a security breach and

“it surfaced that the complaint…was concocted and merely made to avoid repercussions of his own acts”.

The affidavit said that Kumar has the potential

“to exert pressure, influence, and sway the witnesses associated with the…Chief Minister’s House/Camp Office. All the staff still reports to the petitioner. Even the Assistant Section officer…mentions that the petitioner was called on his phone to inform about the arrival of Ms Swati Maliwal on the day of the incident.”

It further said that while a PWD engineer expressed his inability to enter the residence of the CM and retrieve the DVR, Kumar had “unrestricted access.”

The affidavit added that Maliwal, in a statement recorded before the Delhi High Court last month, stated that the manner in which the

“entire AAP leaders and workers came in support of the Petitioner against one of their own Members of Parliament shows that there is a larger conspiracy”.

It said that her statement becomes relevant in view of

“the complete U-turn taken publicly by two responsible persons of the party regarding the same incident in the days following the commission of the crime”.

The Delhi Police further said that Kumar has a criminal antecedent with a case registered in Noida in which he is accused of using criminal force against a public servant and threatening them.
