A criminal revision petition has been filed in Delhi’s Rouse Avenue Court seeking an FIR against Sonia Gandhi for her name allegedly appearing in the electoral roll in 1980, three years before she became an Indian citizen.
A criminal revision petition has been filed before the Rouse Avenue Court in Delhi challenging a magistrate’s order that had refused to direct the registration of a first information report (FIR) against Congress leader Sonia Gandhi.
The plea claims that Gandhi’s name appeared in the electoral roll three years before she officially became an Indian citizen.
The matter came up before Special Judge (PC Act) Vishal Gogne on Friday, who directed that the case be listed for further consideration on December 9.
The petition has been filed by Vikas Tripathi, who is challenging the September 11 order of Additional Chief Judicial Magistrate (ACJM) Vaibhav Chaurasiya.
According to Tripathi,
“Gandhi’s name was included in the electoral roll of the New Delhi constituency in 1980 even though she became a citizen of India only in April 1983.”
Tripathi further explained that
“Gandhi’s name was included in the electoral roll in 1980, deleted in 1982 and then included again in 1983.”
He argued that
“The inclusion of her name in the electoral roll in 1980 means some forged documents were submitted, and there is a case showing that a cognisable offence has been committed.”
His lawyers emphasised this point, saying that there is a clear need to investigate the matter as a potential criminal offence.
However, Judge Chaurasia had earlier rejected the petition, stating that
“The Court cannot embark upon such an inquiry as it would result in unwarranted transgression into fields expressly entrusted to the constitutional authorities and would be a violation of Article 329 of the Constitution of India.”
The case has now been listed for December 9, when the Rouse Avenue Court will consider the criminal revision plea filed by Tripathi.
