Modi, the brother of former IPL chief Lalit Modi, remains in police custody following allegations of rape and criminal intimidation.
The hearing, conducted by Additional Sessions Judge Vipin Kharb, saw initial arguments from Modi’s defence team led by Senior Advocate Ramesh Gupta, joined by Advocates Arshdeep Khurana, Shailendra Singh, and Surya Pratap Singh. The court allowed them to defer after the defence requested more time, as Modi is scheduled to remain in custody until Sunday.
During the proceedings, the court raised concerns over the Look-Out Circular (LOC) issued against Modi within five days of the FIR. Justice Kharb remarked:
“You are seeking bail in police custody? I also want to know how an LOC could be issued in five days.”
The defence responded, noting that
“the FIR was registered on September 10 and the LOC was issued soon after, which led to Modi’s detention at Delhi’s IGI Airport on September 18 upon his return from London.”
Counter-Complaint and Police Remand
The court emphasized that the police should investigate a counter-complaint filed by Modi, alleging extortion by the complainant. On September 19, Modi was granted a two-day police remand, later extended by Additional Chief Judicial Magistrate Deepak Vats. The Delhi Police also sought an additional three days’ remand for further investigation.
Meanwhile, the complainant’s counsel, Senior Advocate Avi Singh, requested an in-camera hearing, citing the sensitive nature of the case. Justice Kharb directed:
“Media and outsiders are to exit before we continue proceedings.”
Allegations Against Samir Modi
Samir Modi was arrested on September 17 following a complaint by a 31-year-old woman alleging rape and criminal intimidation. According to police records, the complainant, a former colleague of Modi, claimed that between 2019 and 2025 she was “coerced into a physical relationship under the pretext of marriage and professional advancement.” She further alleged that Modi “threatened her” and had her removed from her position in 2022, before rehiring her later.
A case has been registered at the New Friends Colony Police Station under Sections 64 (rape) and 351 (criminal intimidation) of the Bharatiya Nyaya Sanhita (BNS). The issuance of the LOC and Modi’s arrest at the airport have intensified public scrutiny of the proceedings.
