A local court in Uttar Pradesh has postponed the Sambhal Jama Masjid case till December 3 following a Supreme Court stay on proceedings. The dispute involves claims that the mosque stands on the site of the ancient Harihar Temple.
A local court in Uttar Pradesh has postponed the hearing in the Sambhal Jama Masjid case because the Supreme Court has put a stay on the proceedings. The case is about ownership claims over the Shahi Jama Masjid premises.
The Muslim side had earlier approached the Allahabad High Court, challenging the trial court’s order that allowed a survey of the mosque area.
Earlier, on May 19, the Allahabad High Court had upheld the trial court’s decision and instructed the lower court to continue hearing the case. But now, the trial court of Civil Judge (Senior Division) Aditya Singh has adjourned the hearing and fixed the next date for December 3.
Advocate Shakeel Ahmad Warsi, who represents the mosque side, explained the reason for the adjournment.
He said,
“Since the appeal is pending before the apex court, the trial court has fixed the next hearing for December 3.”
He also mentioned that the case has been listed for hearing in the Supreme Court on November 7.
On the other hand, Advocate Gopal Sharma, who represents the Hindu side, said that the trial court decided to defer the hearing after considering the Supreme Court’s stay order.
He confirmed,
“Since the appeal is pending before the apex court, the trial court has fixed the next hearing for December 3,”
The dispute dates back to November 19 last year when the Hindu side, represented by advocates Harishankar Jain and Vishnu Shankar Jain, along with others, filed a petition in the district court.
They claimed that the site of the Shahi Jama Masjid was originally the location of the ancient Harihar Temple. Following their petition, the court ordered a survey of the mosque premises on November 19, 2024, and again on November 24, 2024.
However, during the survey process, violence broke out in the area. The clashes turned serious, leading to the death of four people and injuries to 29 policemen who were deployed at the site.
At present, the proceedings in the trial court will remain on hold until the Supreme Court hears the matter and gives further directions. The next date of hearing in the Sambhal court has been fixed for December 3.
