The complaint, filed by Divyanshu Kishore, a leader of a Hindu outfit, was submitted to the Chief Judicial Magistrate (CJM) Court of Muzaffarpur on July 2. The court has accepted the complaint, and Sections 299, 302, and 356(1) of the newly-notified Bharatiya Nyaya Sanhita (BNS) of 2023 have been invoked in the case.
The next hearing is scheduled for July 15.
Sumit Kumar, the complainant’s advocate, elaborated on the charges, stating,
“A case has been filed against Congress leader Rahul Gandhi. Yesterday in the Lok Sabha, he stated the Hindus and my client Divyanshu Kishore had filed the case. The section which has been imposed is 299, 302, 356 (1) under Bharatiya Nyaya Sanhita (BNS) of 2023. The court has accepted the complaint.”
Section 299 of BNS addresses deliberate and malicious acts intended to outrage religious feelings by insulting religion or religious beliefs.
Section 302 deals with uttering words with the deliberate intent to wound religious feelings.
Meanwhile, Section 356(1) pertains to defamation.
The controversy stems from Mr. Gandhi’s speech on July 1 during the Motion of Thanks in the 18th Lok Sabha. In his maiden speech, he criticized the Bharatiya Janata Party (BJP) for allegedly spreading violence and hate. He stated,
“Those who call themselves Hindus indulge in hate and violence round the clock.”
Prime Minister Narendra Modi interrupted Mr. Gandhi’s speech, emphasizing the gravity of the statement. He remarked,
“The issue is a serious one. To call the entire Hindu community violent is serious.”
The case against Mr. Gandhi has garnered significant attention, with political analysts and the public closely watching the developments. As the court prepares for the next hearing, the implications of this legal battle could have far-reaching effects on the political landscape in India.
