[Pune Porsche Crash] Court Allows Police to Take Custody of Teen’s Father for Kidnapping & Wrongful Confinement of his Driver

In the Pune accident case, including the custody of the minor driver’s father and the technical inspection of the Porsche Taycan involved in the crash.

PUNE, MAHARASHTRA: Today (27th May): In the Pune accident case, a Pune court allowed the police to take custody of Vishal Agarwal, the father of the 17-year-old minor driver involved in the accident. Additionally, a team of representatives from Porsche has conducted a technical inspection of the luxury car involved in the crash that killed two IT professionals.

On May 19th, 2023, a speeding Porsche Taycan, allegedly driven by a 17-year-old minor, hit a motorcycle in the Kalyani Nagar area of Pune, resulting in the deaths of two IT professionals. The police claim that the minor was under the influence of alcohol at the time of the accident.

Vishal Agarwal, the father of the minor driver, is currently in judicial custody in a case registered against him and the managers and owners of two pubs under the Juvenile Justice Act. The Pune police had moved an application for a production warrant of Agarwal in the kidnapping and wrongful confinement case of the family’s driver.

The court granted the application, and Agarwal will be taken into custody from the Yerwada Central Jail. The police claim that Agarwal and his father, Surendra Agarwal, put pressure on the family’s driver to take the blame for the accident by offering him money and giving him threats.

Meanwhile, a team of representatives from Porsche reached the Yerwada police station on Monday to conduct a technical inspection of the luxury car involved in the accident. The electric sports sedan was allegedly driven by the 17-year-old minor at the time of the crash.

The regional transport officer, Sanjiv Bhor, confirmed that the Porsche team is conducting the inspection along with officials from the regional transport office. The car was seized by the police after the accident and has been kept on the police station premises.

The police station registered a case against the juvenile driver under relevant sections of the Indian Penal Code and Motor Vehicles Act, including charges of rash driving and causing death by negligence.

The police have charged the minor with rash and negligent driving and causing harm by endangering life or personal safety under IPC Sections 304A, 279, 337, 338, and 427, along with relevant sections of the Maharashtra Motor Vehicle Act.

Additionally, Pune City Commissioner of Police Amitesh Kumar announced that cases would be filed against the driver’s father and the establishment that served the young driver alcohol.

The juvenile court, after considering the circumstances of the case, granted bail to the minor driver. Although the details of the bail hearing were not publicly disclosed, police officials stated that the court did not deem the crime “serious” enough to deny bail. However, the court imposed several conditions on the teenager’s release, aiming to address the gravity of the offense and provide an opportunity for rehabilitation and behavioural correction.

The revocation of bail and subsequent transfer of the teenage driver to an observation home not only addresses the immediate safety concerns but also opens up a dialogue about systemic changes needed in the juvenile justice system and traffic law enforcement.
