Bina Modi PSO’s Plea Against Samir Modi| Delhi Court Orders Police to Submit ‘Action Taken Report’

Today, On 26th June, Metropolitan Magistrate Aridaman Singh Cheema has directed the Delhi police to submit an Action Taken Report (ATR) in response to a plea by Bina Modi’s Personal Security Officer (PSO) against Samir Modi. The court’s directive sets the stage for a hearing scheduled on July 12.

New Delhi: Delhi’s Saket Court on Thursday requested an Action Taken Report (ATR) while considering a plea filed by Bina Modi’s Personal Security Officer (PSO) against her younger son, Samir Modi. The PSO has sought a directive for the registration of a non-cognizable report (NCR) and an investigation into allegations he made against Samir Modi.

It submitted that PSO Surender Prasad Ram served in the CRPF for 20 years and the NSG for two years. Currently, he serves as PSO for Bina Modi.

Metropolitan Magistrate Aridaman Singh Cheema directed the Delhi police to file an ATR.

The matter scheduled for a hearing on July 12.

PSO Surender Prasad Ram filed an application requesting an investigation by police authorities into the alleged offenses committed by Samir Modi, which are punishable under Sections 323, 352, and 506 of the Indian Penal Code. He also seeks the registration of a non-cognizable report (NCR) against him.

Senior advocate Vikas Pahwa, along with advocate Ronak Singh, represented the applicant.

Senior advocate Pahwa argued that the police authorities have not taken action on two complaints dated May 31, 2024, and June 4, 2024, filed by the complainant at Police Station Sarita Vihar.

He also argued that, despite this, the police lodged an FIR based on a complaint filed by Samir Modi regarding an alleged incident on May 30, 2024, which occurred in an office during a meeting where PSO Ram stationed at the gate of the meeting room. He was merely performing his duty.

During the hearing, CCTV footage played in the courtroom, capturing the alleged incident involving Samir Modi and PSO Surender Prasad Ram.

According to the application, on May 30, 2024, the complainant assigned as the PSO to Bina Modi at the Godfrey Phillips India Ltd. (GPIL) office, located at Omaxe Square, Jasola District Centre, Jasola, New Delhi.

The plea states that on May 30, 2024, a meeting taking place in the “Cavanders” meeting room on the 4th floor of the GPIL office.

The application details that Samir Modi arrived at the GPIL office around 12:00 PM and allegedly attempted to enter the meeting room while the meeting in progress and the door closed.

The complainant (PSO) reportedly stepped between Samir Modi and the meeting room door, respectfully requesting permission to seek entry approval from inside the meeting room.

The plea alleges that Samir Modi became enraged upon hearing the request, verbally abused the complainant, grabbed his collar, and physically assaulted him repeatedly.

The complainant also allegedly abused, intimidated, and threatened with dire consequences if he did not allow Samir Modi to enter the meeting room, the plea further stated.

The counsel argued,

“Despite the aggression, the complainant remained calm and continued to request permission for entry since the meeting was ongoing. This clearly evident from the CCTV footage, which recorded the alleged incident.”

The complainant, an ordinary citizen, reportedly suffered physical and mental harm due to Samir Modi‘s actions and remains fearful for his well-being.

PSO Ram filed a complaint with Sarita Vihar police station seeking the registration of an NCR, but no action was taken by the police.

An FIR already been lodged based on a complaint by Samir Modi against the PSO for allegedly assaulting him on May 30, 2024. Following the incident, Modi had to be hospitalized due to a grievous injury to his index finger.
