Who now heads the appellate tribunal that hears the country’s major insolvency, company law and competition disputes? Former Supreme Court judge Justice Rajesh Bindal has been appointed NCLAT Chairperson.

New Delhi: Four months after former Supreme Court judge Justice Ashok Bhushan completed his tenure as NCLAT Chairperson on July 4, 2026, the post has a new occupant. Former Supreme Court judge Justice Rajesh Bindal has been appointed Chairperson of the National Company Law Appellate Tribunal (NCLAT). Justice Bindal confirmed the development on Thursday, November 5, 2026, saying he had been informed of it by email that evening.
Four months under an officiating head
When Justice Bhushan demitted office, Justice Yogesh Khanna, a Judicial Member of the NCLAT, was appointed Officiating Chairperson with effect from July 5, 2026. The Central Government extended his officiating tenure in October.
Details of Justice Bindal‘s tenure and the date on which he will assume charge were not immediately available.
From the Allahabad High Court to the tribunal
Before his elevation to the Supreme Court in February 2023, Justice Bindal served as Chief Justice of the Allahabad High Court. He retired from the top court on April 15, 2026, after serving there for over three years.
In his new role he will head the appellate forum that hears appeals against orders of the National Company Law Tribunal under the Insolvency and Bankruptcy Code and the Companies Act, 2013, as well as appeals in competition law matters.
The NCLAT is the first appellate stage for most corporate insolvency resolution and liquidation disputes, and its rulings shape how resolution plans, creditor claims and promoter liability are decided across the country. A regular Chairperson at its head ends a period in which the tribunal functioned under an officiating arrangement.
The backdrop
The Supreme Court has been examining the functioning of the company law tribunals, including their infrastructure, staffing and delays in deciding matters. Justice Bindal takes over the appellate tribunal against that backdrop.
