New Delhi: In a significant development in the Delhi Waqf Board money laundering case, the Rouse Avenue Court has extended the judicial custody of Aam Aadmi Party (AAP) MLA Amanatullah Khan until October 21. The extension was granted during a hearing on Monday, where Khan appeared via video conferencing from jail.
Amanatullah Khan was arrested on September 2 by the Enforcement Directorate (ED) as part of its investigation into allegations of money laundering connected to the purchase of a property worth Rs. 36 crores in Okhla. Special Judge Vishal Gogne presided over the hearing, where the ED presented its case for continuing Khan’s judicial custody.

The Special Public Prosecutor (SPP) for the ED argued that the extension was necessary to prevent Khan from tampering with evidence, as the investigation is ongoing and Khan is deemed the main accused. The ED has indicated plans to file a supplementary charge sheet against Khan, underlining the seriousness of the allegations and the complexity of the case.
In contrast, Khan’s defense counsel, comprising Advocates Rajat Bhardwaj and Kaustubh Khanna, opposed the extension of judicial custody. They contended that Khan had previously cooperated with the investigation, having appeared before the ED on April 18. They highlighted that data from Khan’s phone was submitted to the authorities on February 9, indicating a level of transparency and cooperation.

Advocate Bhardwaj also pointed out that the ED had initially raided Khan’s residence earlier this year, with four other individuals already in custody since November 2023. The defense team argued that Khan was willing to comply with the investigation and even offered to appear at the ED office daily, requesting his release under any conditional undertaking.
The court’s decision to extend judicial custody reflects the serious nature of the allegations against Amanatullah Khan and the ED’s concerns regarding potential evidence tampering.
