A Delhi court denied bail to Mohit Goyal, who is accused of forging the signature of prominent lawyer Sidharth Luthra. Goyal allegedly sent a fraudulent legal notice, bearing the fake signature, to officials at IndusInd Bank.

New Delhi: A Delhi court recently denied bail to Mohit Goyal, who accused of forging the signature of Senior Advocate Sidharth Luthra to send a legal notice to the Managing Director and Chief Executive Officer of IndusInd Bank.
The bail application dismissed by Additional Sessions Judge (ASJ) Devender Kumar Jangala of the Patiala House Courts. In his ruling, Judge Jangala emphasized the need to balance the rights of the accused with the interests of society.
He stated,
“Though it is true that the applicant/accused has the Constitutional right to life and liberty as per the Constitution of India, and the liberty of the accused cannot be curtailed without following the settled principles of law, the court must also consider the societal interest. The applicant/accused is a habitual offender involved in 40 other cases of a similar nature. Therefore, if he is released on bail, there is every likelihood of him repeating the offence, as he has done repeatedly. Keeping in view the interest of society, the applicant/accused is not entitled to bail. The bail application under Section 439 Cr. PC moved on behalf of the applicant/accused Mohit Goyal for regular bail is accordingly dismissed.”
Goyal’s arrest followed a complaint lodged by Sidharth Luthra, alleging that Goyal had sent a legal notice under Luthra’s name to IndusInd Bank officials. The notice reportedly an attempt to compel the release of funds from a bank account belonging to Preach Well Technologies Private Limited.
The court noted the severity and seriousness of the allegations against Goyal, who facing more than 40 other cases related to cheating and fraud.
During the bail hearing, the court meticulously examined the evidence presented by the prosecution, which included expert testimony confirming the forgery. The prosecution argued that granting bail could jeopardize the ongoing investigation and potentially lead to further tampering with evidence.
The case continues to draw attention within legal circles, raising important discussions about the measures needed to prevent such incidents and protect the sanctity of legal documentation. As the investigation progresses, the legal community awaits further developments, emphasizing the importance of vigilance and integrity in upholding the law.
Representing the Delhi Police, Additional Public Prosecutor Mukul Kumar highlighted the gravity of the charges.
On the other side, Goyal defended by advocates Kaushaljeet Kaith, Yash Chaturvedi, and Praveen Kumar Yadav.
This ruling not only reinforces the judicial system’s commitment to combating forgery and fraud but also highlights the importance of maintaining trust and authenticity within legal proceedings.
