Kadapa Court: No Politics in YS Viveka Case During Campaign

Kadapa Court: No Politics in YS Viveka Case During Campaign

Anantapur: A Kadapa district court issued a temporary injunction on Thursday, directing opposition leaders to refrain from discussing the Y.S. Vivekananda Reddy murder case during the current election campaign, which now under the jurisdiction of the CBI court. The court’s decision came in response to a petition filed by YSRC Kadapa district president K. Suresh Babu.

According to the petitioner,

“The Opposition parties, including APCC chief Y.S. Sharmila, Vivekananda Reddy’s daughter Dr. Suneetha Nareddy, along with leaders from TD, JS, and BJP, were blaming and defaming Chief Minister Y.S. Jagan Mohan Reddy and Kadapa MP Y.S. Avinash Reddy by citing this case.”

In his petition, the YSRC leader listed seven individuals, N. Chandrababu Naidu and Nara Lokesh from the TD, Pawan Kalyan of the Jana Sena, APCC chief Y.S. Sharmila, Vivekananda Reddy’s daughter Dr. Narreddy Suneetha, BJP state chief D. Purandeswari, and Pulivendula TD candidate Ravindranath Reddy (B. Tech Ravi) , who “accusing the CM, despite his lack of involvement in the case.”

The court highlighteded that these accusations prejudiced the ongoing legal proceedings and contravened fundamental principles of justice. This decision followed a review of documents submitted by the petitioners/plaintiffs, notably videos and media articles from various sources.

The Kadapa court noted the absence of evidence supporting claims regarding Avinash Reddy‘s purported role in Vivekananda Reddy‘s murder and allegations of the Chief Minister protecting him.

The court stated,

“In the view of this court, when a case is under consideration by a competent court for resolution, no individual is authorized to assume the role of the court and pass judgment, labeling any involved parties as guilty or murderers based on personal whims and biases.”

The court highlighted worries about political parties and media meddling in legal affairs, noting their role as a ‘public court’ (janata adalat), endangering the principles of ‘innocent until proven guilty’ and ‘guilt beyond reasonable doubt.’

The court cautioned against the perils of media trials and stressed the importance of upholding the integrity of the justice system. With the Vivekananda Reddy murder case pending before the CBI court in Nampally, the Kadapa district court restrained any dissemination labeling Avinash Reddy as his uncle’s murderer and any assertions regarding Jagan Mohan Reddy “shielding him through any medium,” including print, electronic, and social media platforms.

The respondents/defendants directed to promptly remove objectionable remarks made against the YSRC, Jagan Mohan Reddy, and Avinash Reddy from electronic and social media platforms. They also instructed to refrain from personal attacks or criticisms based on allegations or distortions regarding pending cases in competent courts of law, adhering strictly to the prevailing Election Code of Conduct in AP as issued by the Election Commission.

This ad-interim injunction will remain in force until April 30.
