New Delhi, March 29: Bharat Rashtra Samithi (BRS) leader K Kavitha has approached the Rouse Avenue court with a plea that highlights her current predicament in Tihar Jail. Amidst the backdrop of a high-profile legal battle linked to the Delhi excise policy scam, Kavitha’s application seeks permission for home-cooked food and basic amenities, including a mattress, to be allowed during her judicial custody, as per the court’s order dated March 26, 2024.

Kavitha’s plea underscores the necessity of these provisions for her health and well-being, emphasizing the need for home-cooked food and a mattress. Additionally, the application requests permission for Kavitha to carry personal items such as spectacles and a japa mala into the jail, alongside other essentials like slippers, bedsheets, books, blankets, pens, sheets of paper, jewellery, and medicine.

However, the plea points out a stark discrepancy between the court’s directives and the reality of Kavitha’s incarceration. It states,

“in complete defiance of the order dated March 26, 2024, none of the articles as directed by the Court were provided or allowed to be carried by the applicant.”

This has raised concerns about the adherence to judicial orders within the prison system, particularly highlighting that Kavitha has been denied even the most basic items like spectacles and japa mala.

The matter caught the attention of Special Judge Kaveri Baweja, who, on Thursday, sought a response from the Tihar Jail authorities regarding the plea. The case is set for a hearing on March 30, 2024, marking a critical juncture in Kavitha’s ongoing legal challenges.

Kavitha’s legal representation includes Advocate Nitesh Rana, along with Mohit Rao and Deepak Nagar, who have been navigating through the complexities of this high-stakes case. The Bharat Rashtra Samithi (BRS) MLC found herself in judicial custody on April 9, 2024, following her arrest on March 15, 2024, by the Directorate of Enforcement (ED) in connection with the Delhi Liquor Policy Scam.

The ED’s investigation has unveiled a purported conspiracy involving Kavitha and top leaders of the Aam Aadmi Party (AAP), including Arvind Kejriwal and Manish Sisodia, aimed at securing favors in the formulation and implementation of the Delhi Excise Policy. Allegations suggest that Kavitha was involved in a transaction amounting to Rs.100 Crore to AAP leaders, a claim that has significantly intensified the scrutiny of the case.

The enforcement agency has conducted extensive searches across the country, resulting in the arrest of 15 individuals, including prominent AAP members. The ED’s diligent efforts have led to the attachment of assets worth Rs.128.79 Crore, deemed proceeds of crime, further solidifying the case’s foundation.

As the legal proceedings unfold, Kavitha’s plea for basic amenities in Tihar Jail brings to light the human aspects of judicial custody, emphasizing the importance of ensuring the health and dignity of those under trial.
