Maharashtra: A court in Mumbai on Wednesday dismissed the bail application submitted by Naresh Goyal, the founder of Jet Airways, who sought release on medical grounds amidst a case of money laundering against him.

The presiding special judge, MG Deshpande, while disallowing the bail, did permit Goyal to stay hospitalized for his cancer treatment, emphasizing that a permanent release based on his health condition was not justified.

In a notable statement, the court articulated,

“Goyal’s hospitalization is continued. He may consult and can take a second opinion of the cancer experts in Tata Memorial hospital, Mumbai to overcome his illness or else ED may also approach the hospital with all the medical papers of Goyal and in case if the doctors in Tata Hospital require physical examination Goyal with any new tests, ED shall not oppose the same and cooperate everyone in that event.”

This directive underscores the court’s consideration for Goyal’s health while maintaining its stance on the legal proceedings.

The case’s intricacies deepened when Goyal, after the Bombay High Court dismissed his appeal against the arrest by the Enforcement Directorate (ED) related to a default on loans, sought bail from the sessions court. A pivotal moment in the courtroom drama occurred on January 6, when an emotional Goyal implored the court, expressing a profound sense of despair:

“I have lost all hope in life and would rather die in prison,”

-thereby indicating his reluctance to seek medical intervention.

However, a change in circumstances was noted on January 9, when the judge allowed Goyal to seek opinions from private medical professionals. The discovery of malignant tumors during these consultations led Goyal to apply for interim bail, citing urgent health concerns. Although Judge Deshpande authorized a two-month hospitalization for cancer treatment, the request for interim release was denied on February 29.

The saga took a significant turn this Wednesday when Goyal’s plea for medical bail was ultimately refused, though the court agreed to let him remain under medical care in the hospital. This development keeps Goyal’s request for bail based on the case’s merits pending, with a hearing scheduled for April 22, 2024.

The unfolding events highlight the complexities of legal battles intertwined with personal health crises, underscoring the delicate balance the judiciary must maintain between upholding legal principles and addressing human vulnerabilities.
