UTTAR PRADESH: A New legal dispute has emerged in the ongoing Gyanvapi controversy with the filing of a new petition in court, challenging the land swap agreement involving the renowned Kashi Vishwanath Temple. This case centers on a plot of land procured for the development of the Vishwanath Corridor, a project designed to expand the temple premises and enhance accessibility for devotees and visitors.
The petition, lodged by Nityanand Rai, a former Secretary of the Varanasi Bar Association, aims to scrutinize the legitimacy of the land swap executed between the Uttar Pradesh government and the Anjuman Intezamia Masajid Committee.
The legal action targets the exchange mechanism that facilitated the corridor’s expansion, alleging that the process was conducted hastily and improperly handled by the committee to advantageously alter the nature of the property received in the swap.
Representing a devout Hindu group, the petitioner underscores the spiritual and cultural importance of the Aadi Vishweshwar Temple, widely recognized as the Kashi Vishwanath Temple, a major pilgrimage site in Varanasi. They argue that any encroachments or modifications to the temple’s lands must be carefully monitored and prevented to preserve the sanctity of the site.
The contested land swap was formalized on July 10, 2021, when it was registered under Deputy Registrar II. The petitioner challenges the validity of this agreement, citing procedural irregularities and demanding that the transaction be declared null and void. Furthermore, the petition seeks a declaration that all land within the temple precincts should rightfully belong to the Kashi Vishwanath Temple, thereby preserving its sanctity and ownership rights.
Legal representatives Deshratna Srivastava and Supreme Court Advocate Gaurav Singh have apprised the court that the mosque committee intends to change the nature of the house acquired in the swap.
They urged the court to exempt this case from the mandatory notice under Section 80 of the Civil Procedure Code and to expedite the proceedings based on the merits of the case.
