A Lucknow court has sentenced lawyer Parmanand Gupta to 12 years in jail for filing fake SC/ST cases with his associate. The court called it a serious misuse of the law and a betrayal of the justice system.

LUCKNOW: In a judgment, a Lucknow Court has sentenced Advocate Parmanand Gupta to 12 years in prison and imposed a fine of ₹45,000 for filing fake cases under the SC/ST Act.
The court found that Gupta, along with his associate Pooja Rawat, had filed multiple false FIRs using the names of Scheduled Caste individuals to target innocent people and claim government compensation.

Fake Case
According to the prosecution, Parmanand Gupta, a lawyer from Lucknow, colluded with Pooja Rawat to lodge 11 false cases under the SC/ST Act. One of those fake FIRs accused Vipin Yadav, Ramgopal Yadav, Bhagirath Pandit, and Mohammad Tasuk of assaulting Rawat, an incident that, as the court later found, never actually happened.
During the hearing, Pooja Rawat admitted before the Special Judge that she had given a false statement under pressure from advocate Gupta and that the accused were completely innocent. She also told the court that Gupta had taken the ₹75,000 compensation she received from the government under the SC/ST Act provisions.
What the Court Said
Delivering the verdict, Special Judge (SC/ST Act) Vivekanand Sharan Tripathi said Gupta’s actions amounted to a serious misuse of the law and a betrayal of the justice system.
The court convicted Gupta under:
- Section 193 IPC (false evidence)
- Section 420 IPC (cheating)
- Section 3(2)(v) of the SC/ST Act
His sentences under these sections, 3 years, 4 years, and 5 years, respectively, will run consecutively, totaling 12 years of rigorous imprisonment.

The judge also ordered that Pooja Rawat must return the ₹75,000 she received and warned her against participating in any such false cases in the future.
Earlier Life Sentence in Another Fake Case
This is not the first conviction for Advocate Gupta. In August 2025, the same court had sentenced him to life imprisonment and imposed a ₹5.01 lakh fine for lodging a false rape case under the SC/ST Act. Investigations revealed that he had filed a total of 29 fake cases, 11 using Pooja Rawat’s name and 18 in his own.
The court noted that Gupta’s repeated abuse of the law showed a pattern of systematic exploitation of legal provisions for personal benefit.
Strict Directions for Future Cases
To prevent similar misuse, the court has directed that:
- A preliminary inquiry must be conducted before registering any FIR under the SC/ST Act or rape laws.
- Authorities should check how many previous cases have been filed by the complainant or their family.
- Compensation under the SC/ST Act should only be released after the filing of a charge sheet, not before.
The order has been sent to the Lucknow Police Commissioner and the State Government for implementation.
