UTTAR PRADESH: The Allahabad High Court on March 5 ordered a CBI investigation into a case involving multiple allegations of sexual assault. The case was filed by the petitioner Arvind Yadav and Another against the State of Uttar Pradesh, seeking to cancel an FIR lodged against them.

The petitioners claimed that the informant, Pooja Rawat, has a history of filing multiple complaints and FIRs against various individuals. According to them, this is the 12th FIR she has lodged, all of which have been filed through the same lawyer, Parmanand Gupta. They argue that these cases are allegedly being misused for financial extortion.

The division bench of Justice Brij Raj Singh and Justice Vivek Chaudhary noted that a large number of criminal complaints had been registered by Pooja Rawat and her counsel against various individuals, raising concerns about their legitimacy. The petitioners alleged that these FIRs were part of a pattern to pressure and extort money from the accused persons.

The Court noted that it was evident that the woman and her lawyer were conspiring to file false complaints against multiple individuals with the intent of extorting money.

The Court stated,

“Considering the seriousness of the allegations regarding the repeated filing of criminal complaints by the informant, Pooja Rawat, through her counsel, Shri Parmanand Gupta, against numerous individuals in a similar manner, we find it appropriate to direct the CBI to investigate the matter and submit its report.”

The state’s Additional Government Advocate (AGA) confirmed that the informant has been filing multiple cases under different charges and that this FIR is a continuation of the same pattern.

After reviewing the facts, the Court observed,

“It is also apparent that the informant and her counsel are working together and have lodged false FIRs against a large number of people for serious offenses, solely to extort money from them. The present FIR is another such case, filed to create pressure.”

Consequently, the Court ordered a CBI probe into the matter and instructed the agency to submit its report by April 10. Additionally, it granted protection from arrest to the petitioners.

The Senior Registrar of the High Court has been instructed to send a copy of the order to the CBI office in Lucknow to ensure compliance.

The final order states that until further notice, the petitioners will not be arrested in this case unless strong evidence emerges.
