NEW DELHI: In a shocking and serious incident, a court in Delhi witnessed unexpected and disturbing behavior from a convict and his lawyer. This happened right after the court declared the man guilty in a cheque bounce case.

The situation turned aggressive when the convict and his lawyer started abusing and threatening the woman judge openly in the courtroom.

According to the court’s order dated April 2, the convict got angry because the judge did not give a judgment in his favor. In a fit of rage, he even tried to throw an object at the judge and then told his lawyer to do whatever it takes to get a favorable order.

He said to the judge:

“Tu hai kya cheez ………….ki tu bahar mil dekhte hai kaise zinda ghar jaati hai……..(Who even are you… just meet me outside and let’s see how you make it back home alive)”

-as noted in the court’s record.

The woman judge, Judicial Magistrate (NI Act) Shivangi Mangla, had convicted the accused under Section 138 of the Negotiable Instruments Act, which deals with cheque dishonor. She asked the convict to submit bail bonds under Section 437A of the Criminal Procedure Code (CrPC) on the next hearing date.

But instead of cooperating, the convict and his lawyer reportedly began to trouble the judge both mentally and physically. Judge Mangla mentioned in her court order that they pressured her to resign from her post. They were not satisfied with the conviction and wanted her to change the judgment in their favor.

The judge said that they again troubled her by putting pressure to acquit the convict. They even threatened to lodge a false complaint against her and tried to force her to resign. In her order, the judge wrote that proper legal action will be taken for the threats and harassment she faced.

She clearly stated:

“Still the undersigned stand against all the odds and always do needful in favor of justice. The undersigned shall be taking appropriate measures against the accused before National Commission Woman, Delhi for such threatening and harassment.”

Judge Mangla also took strict action against the convict’s lawyer, Advocate Atul Kumar. She issued a show cause notice to him, asking why he should not face criminal contempt proceedings for his misbehavior in court.

The court wrote:

“Court notice be issued to counsel for accused Sh. Atul Kumar to show cause in writing providing relevant explanation for the conduct shown by him today and further to explain as to why he shall not be referred to the Hon’ble High Court for initiating criminal contempt proceedings against him for such misbehavior.”

The lawyer has been asked to give his reply in writing on the next hearing date.

This incident has raised serious concerns about the safety of judges and the growing disrespect towards the judicial system.

It also highlights the need for strong action against those who try to influence court decisions through threats and violence.
