Delhi CM Attack Case: Court Frames Attempt to Murder Charges Against Two Accused

NEW DELHI: A Delhi court formally framed charges against two men accused of attacking Delhi Chief Minister Rekha Gupta during a public event earlier this year. The case will now proceed to trial, with the court ordering in-camera proceedings due to the victim being a public figure.

Additional Sessions Judge Ekta Gauba Mann framed charges against Sakriya Rajeshbhai Khimjibhai and Tahsin Raza Rafiullah Shaikh, both of whom pleaded not guilty after being physically produced before the court.

The court held that a prima facie case exists against both accused under multiple sections of the Bharatiya Nyaya Sanhita (BNS), including:

  • Section 61(2): Criminal conspiracy
  • Section 221: Obstructing a public servant in the discharge of public functions
  • Section 132: Using criminal force against a public servant while on duty
  • Section 109(1): Attempt to murder

The judge observed that all essential ingredients of these offences are made out at this stage.

Background of the Attack

Chief Minister Rekha Gupta was attacked on August 20 during a ‘Jan Sunwai’ programme at her camp office in the Civil Lines area of Delhi. Following the incident, her office described the assault as part of a “well-planned conspiracy to kill her.”

Details of the Accused and Alleged Conspiracy

  • Sakriya Rajeshbhai Khimjibhai (41), a resident of Rajkot, Gujarat, was arrested and booked under charges including attempt to murder.
  • Tahsin Raza Rafiullah Shaikh has been accused of conspiring with Khimjibhai to execute the attack.

According to the prosecution, both accused met in Rajkot, where the conspiracy was allegedly hatched. Shaikh is accused of transferring ₹2,000 to Khimjibhai’s account to facilitate the planning and execution of the attack.

Chargesheet Filed by Delhi Police

On October 18, the Delhi Police filed a 400-page chargesheet against both accused, citing offences such as:

  • Attempt to murder
  • Assaulting a public servant
  • Obstructing a public servant from discharging official duties
  • Criminal conspiracy
