[Defamation Case] Court Suspends Activist Medha Patkar’s Sentence For Remarks Against Delhi L-G VK Saxena

Today, On 29th July, The Saket Court suspended activist Medha Patkar’s sentence for defaming Delhi L-G VK Saxena. Patkar granted bail on a bond of Rs. 25,000 with one surety of the same amount. Additionally, the court issued a notice to the Delhi L-G, requesting his response by September 4.

New Delhi: A Delhi court, On July 29, suspended the sentence given to social activist Medha Patkar in a criminal defamation case filed by former Lieutenant Governor (L-G) of Delhi, V K Saxena.

The Saket court granted Patkar bail on a Rs. 25,000 bond with one surety of the same amount. Additionally, the court issued a notice to the Delhi L-G, requesting his response by September 4.

Previously, on July 1, the court sentenced Patkar to five months in jail and ordered her to pay Rs. 10 lakhs as compensation for harming Saxena’s reputation in a defamation case that is 23 years old.

The sentence suspended until August 1 to allow Patkar time to file an appeal.

Medha Patkar appealed the trial court’s decision from July 1. The case originates from a press release she issued in November 2000. In May of this year, the court noted that Patkar’s statements, which included calling V K Saxena a prominent NGO president in Gujarat at the time a “coward” and accusing him of involvement in hawala transactions, intended to damage his reputation.

Patkar and Saxena have been engaged in a legal battle since 2000 after she sued him for publishing advertisements against her and the Narmada Bachao Andolan. In response, Saxena filed two defamation cases against Patkar in 2001, accusing her of making defamatory remarks about him on television and in a press release.

Earlier this year, Saxena’s legal counsel argued for the maximum possible punishment for Patkar. In contrast, Patkar’s lawyer requested leniency, proposing that she be released on probation given her age and good character.

Patkar ultimately convicted in the 2001 defamation case filed by Saxena. Sentencing arguments were completed on May 30, with the court reserving its decision on the sentence’s length until June 7. On July 1, she sentenced to five months in jail and ordered to pay Rs.10 lakhs in damages. However, this sentence was suspended until August 1 to allow time for an appeal.

On July 29, a Delhi court suspended the sentence and granted Patkar bail on a Rs.25,000 bond with a surety of the same amount. Additionally, the Saket court issued a notice to the Delhi L-G, seeking his response by September 4.
