Court Case Against Congress President Mallikarjun Kharge: “Offending Hindu Sentiments Through His Remarks”

A court case has been filed against Congress President Mallikarjun Kharge in Bihar for allegedly hurting Hindu sentiments. The complaint follows his remarks at a rally in Mau, Madhya Pradesh. Kharge had stated that taking a dip in the Ganga does not remove poverty or feed the hungry. His statement has ignited controversy, leading to legal action.

A complaint has been lodged against Congress president Mallikarjun Kharge in a Muzaffarpur court, Bihar, on January 28, 2025, accusing him of offending Hindu sentiments through his remarks.

Advocate Sudhir Kumar Ojha filed the case in the Chief Judicial Magistrate court, with a hearing scheduled for February 3.

Mr. Ojha claimed that Mr. Kharge exploited the feelings of Sanatani Hindus for political gain.

During a rally in Mau, Madhya Pradesh, the Congress leader stated that,

“Dipping in the Ganga did not eliminate poverty or provide food to hungry stomachs.”

In his complaint, Mr. Ojha sought to initiate a First Information Report (FIR) against Mr. Kharge.

He asserted,

“Mr. Kharge’s statement has hurt the religious sentiments of crore of Hindus and Sanatani. I have filed the complaint in the court against him under Sections 352, 302, and 298 of the Bharatiya Nyaya Sanhita, and the court has admitted it.”

Section 352 addresses intentionally insulting someone in a manner that provokes a breach of peace, with penalties of up to two years in prison, a fine, or both.

Section 302 pertains to the deliberate act of hurting religious feelings, stipulating punishment for anyone who intentionally offends religious sentiments through speech, gestures, or actions. Section 298 deals with defiling or damaging places of worship or sacred objects with the intent to insult a religion.

On January 27, 2025, Mr. Kharge remarked that BJP leaders were competing to take a dip at the Sangam for media attention and questioned whether such acts would eradicate poverty in the country.

He clarified that he did not intend to hurt anyone’s faith and apologized if his comments caused offense, adding that BJP leaders were spending large sums of money to gain favorable television coverage while dipping into the Ganga.

Congress President Mallikarjun Kharge is a senior Indian politician and leader of the Indian National Congress. He has held key positions in the party and served as a Union Minister. Known for his strong advocacy of social justice and secularism, Kharge has been active in national politics for decades.
