Saket court in Delhi issued a notice to the Delhi Police for failing to register an FIR in response to the complaint.
Advocate Vineet Jindal, representing complainant Uday Maholkar, highlighted the seriousness of the issue and emphasized the violation of several laws.
The complaint seeks action under the following legal provisions:
- Section 11 of the POCSO Act
- Sections 294, 295, and 296 of the IPC
- Section 4 of the Indecent Representation of Women (Prohibition) Act
- Section 67 of the IT Act
Advocate Vineet Jindal stated,
“Balaji ALT’s content violates laws and undermines the cultural and moral fabric of society.”
He stressed that airing such content negatively impacts youth and damages cultural values. According to the complainant, the actions of Balaji ALT are criminal and should not go unpunished.
The complaint was filed by Uday Maholkar, founder of the NGO Save Culture Save Bharat and a former RTI Commissioner. In his complaint, Maholkar accused Balaji ALT of promoting inappropriate content that harms the country’s cultural ethos.
After the Delhi Police failed to register an FIR, Maholkar approached the Chief Judicial Magistrate (CJM) at Saket Court.
The court has now directed the Delhi Police to provide an action taken report regarding the complaint. It has also scheduled the next hearing for March 6, 2025, to review the updates provided by the police. The court’s notice to the police highlights the importance of addressing such complaints in a timely manner.
The case is expected to set an important precedent for regulating online streaming platforms, popularly known as OTT platforms.
It calls for stricter adherence to laws and ethical guidelines by such platforms to ensure they do not harm societal values or negatively influence young viewers.
