Excise Policy Case | Arvind Kejriwal’s Role Being Investigated, Completes Probe on All Accused: CBI Tells Court

NEW DELHI: Today(on 6th July),The Central Bureau of Investigation (CBI) has clarified that its ongoing investigation into the excise policy case now solely focuses on the role of Delhi Chief Minister Arvind Kejriwal. This announcement indicating that while the investigation concerning other accused individuals has been completed, Kejriwal’s involvement is still under scrutiny.

CBI counsel Advocate DP Singh emphasized the ongoing nature of this investigation.

“We will inform the Supreme Court about new developments since June 4 that prompted us to arrest Arvind Kejriwal.”

-Singh stated.

The CBI further reinforced that only Kejriwal’s role remains under investigation, with the probe against the other accused nearing completion.

In a prior statement, the Solicitor General clarified that the investigation’s status referred to all arrested accused, excluding Kejriwal. This distinction underscores the current focus solely on the Delhi Chief Minister’s actions and their implications within the excise policy framework.

Earlier on June 4, Solicitor General Tushar Mehta presented submissions to the Supreme Court, noting the anticipated conclusion of the investigation.

He assured the court that –

“A final complaint and charge sheet will be filed promptly, and certainly by July 3, 2024.”

enabling the trial court to proceed with the trial immediately thereafter. This commitment aligns with the court’s directive issued on October 30, 2023, which established a timeline of “6-8 months” for the completion of the investigation.

The Supreme Court, in response to Mehta’s submissions, expressed its expectation for the timely filing of the final charge sheet. It indicated that once the charge sheet is filed, the petitioner would have the liberty to revive his prayer afresh. The court’s observation recognized the structured timeline and the Solicitor General’s assurances regarding the investigation’s conclusion.

The CBI’s current focus on Kejriwal marks a significant development in the excise policy case. The investigation’s progress and the forthcoming charge sheet will play a crucial role in determining the course of the legal proceedings. As the case advances, the legal fraternity and the public await the final outcomes of this high-profile investigation.

On Saturday, legal representatives for Manish Sisodia and K Kavitha made serious allegations against the Central Bureau of Investigation (CBI), accusing the agency of misrepresenting and misleading statements in the ongoing investigation.

“CBI is distorting and misleading statements.”

-they claimed, emphasizing the inconsistencies in the agency’s communications with the court.

In a judicial order dated March 22, the court had observed that the investigation was purportedly complete.

“CBI incorrectly informed the Court that the investigation is complete.”

-the counsels argued, highlighting a significant discrepancy. The current situation reveals that the status report filed is contradictory to previous claims.

“Today, the situation is that the status report filed contradicts this claim.”

– they pointed out, underlining the evolving and conflicting nature of the CBI’s submissions.

Special Judge Kaveri Baweja, presiding over the case on Saturday, decided to extend the judicial custody of Delhi’s former deputy chief minister, Manish Sisodia, along with other accused individuals, until July 15, 2024. This extension indicates the ongoing complexity and seriousness of the case.

In a noteworthy development, the court granted Manish Sisodia permission to sign documents pertaining to the development of his constituency, utilizing MLA funds.

“The Court also permitted Manish Sisodia to sign documents pertaining to the development of his constituency using MLA funds.”

– according to the court’s order.

Additionally, Sisodia was permitted to sign bank checks necessary for his family’s expenditures.

“The court also permitted him to sign bank checks for his family’s expenses.”

-the order specified.

However, the court chose to defer its decision regarding the cognizance of the third supplementary chargesheet filed by the CBI against BRS Leader K Kavitha. This deferral was due to issues with the pagination of the chargesheet.

“The Court also postponed its hearing on the matter of taking cognizance of the third supplementary chargesheet filed by the CBI against BRS Leader K Kavitha.”

-the court noted.

The matter has been postponed to July 8, 2024, for further consideration.

“The court deferred the matter to July 8, 2024, after noting that some pages of the chargesheet are incorrectly paginated.”

-it was observed.
