BREAKING | Actor Allu Arjun Appears Before Court Virtually, Files Regular Bail Petition In Theatre Stampede Case

Allu Arjun was arrested on December 13 after the case was filed against him in relation to the stampede that occurred on December 4 at Sandhya Theatre during the premiere of Pushpa 2: The Rule, which resulted in a woman’s death.

Hyderabad: Actor Allu Arjun is scheduled to appear virtually before the Nampally Court on Friday(27th Dec) in connection with the Sandhya Theatre stampede case. He has also filed a petition for regular bail, which is expected to be heard later in the day.

Allu Arjun was arrested on December 13 after the case was filed against him in relation to the stampede that occurred on December 4 at Sandhya Theatre during the premiere of Pushpa 2: The Rule, which resulted in a woman’s death.

The Nampally Court had initially sent the actor to judicial custody for 14 days, but his lawyers approached the High Court, which granted him interim bail on the same day. The High Court directed him to seek regular bail from the trial court. Allu Arjun, who was named as accused number 11 in the case, was released from Chanchalguda Jail the following day.

As his 14-day judicial remand ends on December 27, the actor must present himself before the court for further proceedings. His lawyers have requested permission for his virtual appearance, citing concerns that his physical presence could lead to chaos at the court.

Allu Arjun’s lawyers, Niranjan Reddy and Ashok Reddy, have filed a petition for regular bail under Section 436 of the Code of Criminal Procedure (CrPC), 1973. On December 24, the police interrogated him for three hours at Chikkadpally Police Station, based on a 10-minute video compiled from CCTV footage of the incident. The police released the video to counter the actor’s claims about what transpired.

As per Section 436 of the CrPC, when any person other than a person accused of a non-bailable offence is arrested or detained without warrant by an officer or appears or is brought before a Court, and is prepared at any time while in the custody of such officer or at any stage of the proceeding before such Court to give bail, such person should be released on bail, provided that “such officer or Court, if he or it thinks fit, may, and shall, if such person is indigent and is unable to furnish surety, instead of taking bail from such person, discharge him on his executing a bond without sureties for his appearance as hereinafter provided.” Furthermore, Bail is discretionary in case of a non-bailable offence. The process of obtaining regular bail typically begins with the filing of a bail application by the accused or their legal representative. This application is usually submitted to the court having jurisdiction over the case. The court then considers various factors before deciding whether to grant bail or not.

Now Under Section 478 in BNSS lays the law for regular bail. In other words, it provides the circumstances when a person gains the right to be released on bail in cases of bailable offences. Another positive aspect is the special provision regarding bail for indigent persons unable to furnish surety, to be discharged on executing bond for appearance.

During a December 21 Assembly session, Chief Minister Revanth Reddy criticized Allu Arjun for visiting the theatre without police permission and conducting a “roadshow” both before and after the incident. Hours later, Allu Arjun held a press conference, denying the allegations and expressing his hurt over the character assassination.

The day after the stampede, the police filed charges of culpable homicide not amounting to murder against Allu Arjun, the theatre management, and his team.
