MP Jairam Ramesh: “Congress to Challenge ‘Constitutionality’ of Waqf Amendment Bill in SC”

Congress leader Jairam Ramesh stated that the party will challenge the Waqf Amendment Bill’s “constitutionality” in the Supreme Court. He raised concerns over its impact on minority rights and legal fairness. The bill was passed in Parliament during the early hours of Friday. Congress is preparing for a legal battle to contest its validity.

Congress MP and General Secretary in charge of Communications Jairam Ramesh announced on Friday that the party plans to challenge the “constitutionality” of the Waqf Amendment Bill in the Supreme Court, following its passage in Parliament during the early hours of Friday.

In a social media post on X, Ramesh detailed the party’s ongoing legal initiatives, mentioning that Congress is already contesting several laws in the Supreme Court, including the Citizenship Amendment Act (CAA) of 2019, modifications to the Right to Information (RTI) Act of 2005, and changes to the Conduct of Election Rules (2024).

The party is also intervening to uphold the Places of Worship Act, 1991.

Ramesh stated,

“The INC’s challenge of the CAA, 2019, is being heard in the Supreme Court. The INC’s challenge of the 2019 amendments to the RTI Act, 2005, is being heard in the Supreme Court. The INC’s challenge to the validity of the amendments to the Conduct of Election Rules (2024) is being heard in the Supreme Court. The INC’s intervention to uphold the letter and spirit of the Places of Worship Act, 1991, is being heard in the Supreme Court. The INC will very soon be challenging in the Supreme Court the constitutionality of the Wakf (Amendment) Bill, 2024,”

He expressed confidence in the party’s legal efforts, affirming that Congress will persist in opposing any actions by the Modi government that it perceives as attacks on the foundational principles of the Constitution of India.

He added,

“We are confident and will continue to resist all assaults of the Modi Government on the principles, provisions, and practices that are contained in the Constitution of India,”

The Waqf Amendment Bill 2025 was passed by Parliament after a lengthy and intense debate.

The Rajya Sabha convened beyond midnight to finalize the legislation, with Chairman Jagdeep Dhankhar announcing, “Ayes 128 and Noes 95, Absent zero. The Bill is passed.”

The Lok Sabha had also debated the Waqf (Amendment) Bill on Wednesday, ultimately passing it just after midnight.

The government introduced this revised bill after incorporating recommendations from the Joint Parliamentary Committee, which reviewed the legislation initially proposed in August of the previous year.

The bill aims to amend the 1995 Act, improving the administration and management of Waqf properties in India. Its goals include addressing the deficiencies of the earlier act, enhancing the efficiency of Waqf boards, streamlining the registration process, and increasing the use of technology in managing waqf records.
