NEW DELHI: The recent US military attack on Iran’s nuclear facilities has created a serious international crisis, with deep legal and diplomatic consequences.

Prominent Indian political and legal voices, Kapil Sibal and Prashant Bhushan, have sharply criticized the US action and demanded that India take a clear stand.

In a direct tweet, senior advocate and Rajya Sabha MP Kapil Sibal expressed his concern over India’s silence and said:

“America Attacks Iran’s Nuclear Facilities

India : Take a position and condemn the US

The global south will never forgive us

No wishy-washy statements please !

Trump has embarrassed us enough

Stand up India
Time to do the right thing !”

Legal activist and senior Supreme Court lawyer Prashant Bhushan also tweeted his strong objection, calling the US strike a serious breach of international and American laws:

“The US direct attack on Iran is a grave violation of International Law and US domestic law which requires approval from the Congress.
It will drag the world into a more widespread war, with very dangerous consequences.
Iran will have every right to respond to US aggression”

Decades of Tension Behind the Current Crisis

The US-Iran-Israel conflict has a long and complicated history. Iran has always opposed Israel’s right to exist as a country, while Israel considers Iran’s nuclear program a threat to its safety. Because of this, Israel has been suspected of secret operations like sabotaging Iran’s nuclear work and killing its nuclear scientists.

America’s involvement is connected to its strong alliance with Israel and its fear of Iran developing nuclear weapons. In 2015, the Iran Nuclear Deal (JCPOA) was signed to stop Iran from enriching uranium too much, in return for lifting economic sanctions.

However, in 2018, President Donald Trump withdrew the US from the deal. After that, Iran restarted its nuclear program at a faster rate, raising serious security concerns.

The latest US airstrike shows a major shift from peace talks to open military action, creating new risks for war in the region.

Legal Violations Under International Law

From a legal point of view, the US airstrike is very problematic. As per Article 2(4) of the United Nations Charter, no country is allowed to use force against another country’s territory or political freedom, except in self-defense (Article 51) or with permission from the UN Security Council. In this case, there has been no such approval.

The Geneva Conventions and other rules of war also apply when there is armed conflict. All military actions must follow international rules, especially about avoiding civilian harm and using force only when needed.

If civilian areas or nuclear sites are attacked without proper reasons, these acts can be considered war crimes.

Can Iran Go to the International Court of Justice (ICJ)?

The International Court of Justice (ICJ) is the top legal body of the United Nations. It can hear cases between countries, including when one country violates international law. Iran could file a case at the ICJ against the US for attacking its territory without justification.

But there’s a problem—the ICJ can only act if both countries agree to its authority. Even if Iran files a case, the US may not accept the ICJ’s jurisdiction. And even if the ICJ gives a judgment, it is hard to enforce without cooperation from both countries.
