Jammu & Kashmir’s National Law University Finally Opened: ‘The Challenge is to Make it a Top Institute’

J&K’s National Law University finally opened. Now, the challenge is to make it a top institute. Good teachers, better facilities, and strong research are important. The university must grow with proper planning and hard work.

During his Budget address, Chief Minister Omar Abdullah announced the establishment of a National Law University (NLU) in Jammu and Kashmir, fulfilling a long-standing demand for a premier legal institution in the region.

He disclosed that Rs.50 crore has been allocated for the development of this anticipated project.

The path to creating an NLU in Jammu and Kashmir has been lengthy and challenging. In 2018, law students were hopeful when the then PDP-BJP coalition government passed the J&K National Law University Bill in the legislative assembly.

This passage was viewed as a significant step toward providing quality legal education in the region. However, the bill required the governor’s approval to become law. During Governor N. N. Vohra’s tenure, requests for clarifications led to an indefinite delay.

It wasn’t until October 1, 2019, that Governor Satya Pal Malik granted his formal assent, finally laying the legal foundation for the university’s establishment.

However, this approval coincided with a period of political turmoil in Jammu and Kashmir, as the abrogation of Article 370 on August 5, 2019, altered the region’s status and resulted in its division into two Union Territories Jammu & Kashmir and Ladakh.

This political shift further postponed the implementation of the NLU, requiring amendments to the J&K National Law University Act to be adopted by the Union Ministry of Home Affairs.

Now, more than five years have passed, and the university remains an unfulfilled promise. The extended delay has caused frustration among law students, who feel deprived of the opportunities available to their counterparts in other regions of the country. Despite having the legal framework established, there has been no progress on the ground.

The first priority should be to accelerate the establishment process. The university must not face the same challenges that caused years of delays. The government should set clear timelines for land acquisition, faculty recruitment, and student admissions.

Next, selecting a suitable location is essential. The university should be established in a centrally accessible area to facilitate attendance for students from both Jammu and Kashmir. Ideally, it should be situated on the outskirts of Srinagar or in central Kashmir, allowing convenient access for students from all regions.

Funding is also a major concern. While the government has allocated Rs.50 crore, this amount is inadequate for creating a world-class NLU. A significant portion of this budget will likely be consumed by land acquisition, leaving little for infrastructure, faculty recruitment, and student facilities.

Therefore, the government must increase the funding in the next budget, pursue additional central funding, and explore public-private partnerships to develop the university on par with India’s top NLUs.

Although budget constraints are a significant challenge, we must ensure that academic excellence remains uncompromised. The NLU should not merely be another law school it must meet the standards of institutions like NLSIU Bangalore, NALSAR Hyderabad, and NUJS Kolkata. To achieve this, the university must prioritize quality.

Accessibility is another crucial factor. The university should implement inclusive admission policies to ensure that students from underprivileged backgrounds are not overlooked. Scholarships, fee waivers, and financial aid programs should be introduced to support deserving yet economically disadvantaged students.

The announcement of the National Law University in Jammu and Kashmir marks a historic milestone, but it is just the beginning. The challenge now lies in transforming this promise into reality.
