EX-CJI DY Chandrachud: “If a Judge Has a Concern, the Right Step Is to Talk to the Chief Justice”

New Delhi: Former Chief Justice of India D.Y. Chandrachud emphasized the importance of internal dialogue among judges, stating that if a judge has concerns about a specific decision, the appropriate course of action is to approach the Chief Justice for discussion rather than airing grievances publicly.

He made these remarks during a “Fireside Chat” at the “Vidhi Utsav 2025, The Festival of Law, Legal Literature and Luminaries,” organized by Oakbridge Publishing.

Justice Chandrachud remarked,

“Judicial institutions cannot function efficiently without a well-defined procedure that ensures certainty, objectivity, and transparency.”

He highlighted the necessity for consistency in judicial processes, noting,

“If an individual judge has a quibble about a particular decision, the correct thing is to talk to the Chief Justice and get it sorted out.”

He cautioned that public discussions might undermine the integrity of institutional roles.

He further stated,

“The bench requires uniformity, as it deals with the bar, which expects a degree of certainty regarding how cases will be handled.”

He illustrated his point with the example of a high court having multiple benches, suggesting that differing procedural modalities could lead to chaos.

Justice Chandrachud also addressed the need for changes within judicial institutions to be institutionalized, stating,

“Changes should not be viewed as individual-centric. They must be entrenched within the system to avoid disruption when there’s a change in leadership.”

He concluded,

“Establishing institutions and processes is as crucial as making substantive decisions.”

Former CJI DY Chandrachud stressed the importance of internal dialogue among judges, urging them to discuss concerns with the Chief Justice rather than airing them publicly.

Speaking at Vidhi Utsav 2025, he emphasized the need for consistency and transparency in judicial processes. He warned that public disagreements could undermine institutional integrity. Chandrachud also highlighted the necessity of institutionalizing changes to ensure stability beyond individual leadership.
