“Government Blatantly Violates Students’ Fundamental Right to Education”: Civil Rights Organization Urges CJI for Urgent Action on Poor Schools Conditions

Today, On 16th August, A civil rights group, Social Jurist, urged Chief Justice of India D.Y. Chandrachud to take judicial notice of the dire conditions in state-run schools in Madhya Pradesh. In a letter sent on Friday, the NGO highlighted the deteriorating infrastructure of five schools in the Khajuraho district, supporting its claims with photographs of the dilapidated buildings.

New Delhi: A civil rights organization, Social Jurist, wrote a letter to Chief Justice of India (CJI) D Y Chandrachud on Friday, urging him to take “judicial note” of the conditions in state-run schools in Madhya Pradesh.

The letter emphasized the need for government schools to have modern, state-of-the-art facilities.

The group highlighted several critical issues,

“No sweeper is posted in any of the schools, leaving all washrooms in an unhygienic condition. There is a severe shortage of teachers in the schools compared to the number of students enrolled. The government of Madhya Pradesh must immediately make arrangements for teachers.”

The letter argued that the poor and unhygienic conditions in these schools violate students’ right to education, as guaranteed under Articles 14, 21, and 21-A of the Indian Constitution, which ensure the right to equality, protection of life and personal liberty, and the right to free and compulsory education, respectively.

It also raised concerns about the school uniforms being made of synthetic material, which could potentially cause skin problems.

The letter concluded by stating,

“The inactions highlighted demonstrate the Madhya Pradesh government’s blatant violation of students’ human and fundamental rights to education. Therefore, through this letter, we seek the intervention of this Hon’ble Court to treat it as a PIL and request Your Lordships to issue necessary directions to the government of Madhya Pradesh.”

The concerns based on a recent visit by an associate of the NGO to several government schools in the Khajuraho district, including CM Rise Government Senior Secondary School, Government Utkrisht Middle School, Government Utkrisht Senior Secondary Vidyalaya, Raj Nagar, Government Primary School, Bandargarh, and Government Primary School, Chobar.

This appeal for judicial intervention highlights the urgent need for reforms in the state’s educational infrastructure to safeguard the rights and well-being of students in Madhya Pradesh.
