Advocate Sues McDonald’s Over Burger Mix-Up At Mumbai Airport: "Ordered Veg, Got Chicken"

MUMBAI: An unexpected burger mix-up at Mumbai Airport in McDonald’s India in legal trouble. Advocate Ashutosh J. Dubey has filed a legal notice against the fast-food giant, alleging that he was served a chicken burger despite ordering a vegetarian meal on the auspicious day of Shravan Somvar and Ekadashi. Citing religious violation and emotional distress, Dubey is now seeking compensation and a formal apology from the company.

However, what he received, and unknowingly consumed, was a Mexican Grill Chicken Cheese Burger.
For a devout Hindu observing a religious fast, the consumption of non-vegetarian food on such a day isn’t just a mistake; it is seen as a grave religious transgression.

Dubey’s outrage stemmed not just from the mix-up, but also from what he described as the casual, dismissive attitude of the McDonald’s staff. According to him, their only response was,

“Sorry, sir. Non-veg hi toh tha.”

Calling it a blatant violation of his religious beliefs, Dubey has now taken the legal route. He has sent a legal notice to McDonald’s India, invoking critical provisions under the Bharatiya Nyaya Sanhita, 2023.

  • Section 318(2): Acts intended to outrage religious feelings.
  • Section 331(2): Wounding religious sentiments.

In his notice, he has demanded the following:

  • A formal public apology from McDonald’s India.
  • Compensation of Rs 5 lakh for mental agony and religious violation.
  • Implementation of religious and dietary sensitivity training for all McDonald’s staff.

Dubey has warned that if a satisfactory response is not received within 7 days, he will initiate criminal and consumer legal proceedings.

In his message, he announced a personal boycott of McDonald’s India, urging others to hold the company accountable for what he sees as a disregard for India’s religious and cultural sensitivities.
