In May 2023, the Supreme Court Collegium, led by then Chief Justice of India DY Chandrachud, put forward Kumar’s name for the judgeship. The recommendation originated from the Allahabad High Court Collegium in September 2022 and was first reviewed by the Supreme Court Collegium on January 17, 2023.
At that time, the Collegium postponed the proposal due to concerns raised by an Intelligence Bureau (IB) report, requesting specific details that supported its findings.
Earlier, On May 3, 2023, the Department of Justice sent an IB report dated February 1 to the Supreme Court, indicating that no further information was available.
Following this, the Supreme Court Collegium recommended Kumar for the position of High Court judge.
