The case, which has been a point of contention, stems from a statement allegedly made by Gandhi during an election rally near Bhiwandi on March 6, 2014. According to the complaint filed by Rajesh Kunte, a local member of the Rashtriya Swayamsevak Sangh (RSS), Gandhi accused the RSS of being involved in the assassination of Mahatma Gandhi, stating that
“the RSS people killed (Mahatma) Gandhi.”
This accusation has led to the ongoing defamation suit against the Congress leader, highlighting the intense political rivalry and historical contention between the parties involved.
Rahul Gandhi’s counsel, Advocate Narayan Iyer, presented an application for adjournment, citing the reason that a writ petition filed by the Wayanad Member of Parliament in the Bombay High Court regarding the defamation case is still pending. This legal maneuver is part of the defense’s strategy to ensure that all related legal proceedings are considered and resolved before moving forward with the defamation case.
The request for adjournment, however, was met with opposition from Advocate Prabodh P Jaywant, representing the plaintiff, Rajesh Kunte. Jaywant argued against the delay, pointing out that the court had previously imposed a penalty on the complainant for seeking an adjournment and insisted that the same standards should apply to the accused, Rahul Gandhi. This exchange underscores the legal tug-of-war and the high stakes involved in this defamation case.
