INDORE: Today(on 5th April), The Indore bench of the Madhya Pradesh High Court has made a decision regarding the contentious Bhojshala-Kamal Maula Mosque complex in Dhar. The court has rejected a plea by an individual seeking involvement in the ongoing scientific survey of the complex, a survey that is being meticulously conducted by the Archaeological Survey of India (ASI).
The plea, filed by Kuldeep Tiwari, one of the original petitioners urging the High Court to order the survey, sought permission for his participation in the scientific examination of the site. However, the division bench, comprising Justice SA Dharmadhikari and Gajendra Singh, dismissed this application in a ruling on Thursday.

Explaining the rationale behind their decision, the bench remarked-
“The survey is on the verge of completion. Ultimately, the bunch of petitions shall be finally decided based on the report of the ASI after completion of the survey.”
This statement highlighted the court’s stance on awaiting the comprehensive findings of the ASI before proceeding with any judgments related to the petitions.
The order, disclosed on the MP High Court website on Friday, clearly states-
“Considering the above, there’s no reason to allow the petitioner to join or be present during the survey.”
This refusal emphasizes the court’s commitment to maintain the survey’s credibility by restricting participation to those directly involved in its conduct.
This ongoing survey, initiated on March 22 following a High Court directive on March 11, is not just a matter of archaeological interest but also a reflection of the deep-seated religious sentiments associated with the Bhojshala-Kamal Maula Mosque complex.
The site, a testament to India’s rich cultural tapestry, is revered by Hindus as a temple dedicated to Vagdevi (Goddess Saraswati) and by Muslims as the Kamal Maula Mosque, illustrating the multifaceted heritage of the region.

Since April 7, 2003, the Archaeological Survey of India has acknowledged the significance of the complex to both communities. Under a special arrangement, Hindus can conduct puja on Tuesdays, while Muslims are granted permission to offer namaz on Fridays. This harmonious coexistence of religious rituals highlights the complex’s role as a symbol of India’s rich cultural and religious diversity.
