The case has attracted attention at the highest levels, with Solicitor General Tushar Mehta representing the ED. Mehta highlighted that Soren’s arrest was already under challenge in the Jharkhand High Court, which had scheduled a hearing for today. He expressed concern about the fairness towards the High Court, stating,
“It would be unfair to the High Court because at their request, it is kept and the matter was kept today first on board.”
In response to these developments, Kapil Sibal, representing Soren, informed the Supreme Court that the plea before the High Court would be withdrawn. Sibal emphasized the urgency and seriousness of the matter, arguing,
“We are withdrawing it. We wanted it heard last night. Please, let this Court (Supreme Court) decide it. There is my undertaking that we are withdrawing… This is a very serious matter… Everybody will be jailed before elections.”
The gravity of the allegations was acknowledged by Additional Solicitor General SV Raju, who remarked,
“Allegations are also very serious.”
This statement was further echoed by Solicitor General Mehta, who added,
“Hundreds get arrested every day.”
The Chief Justice of India, DY Chandrachud, recognizing the significance and the charged atmosphere of the case, advised the lawyers to
“Keep the ammunition all charged for tomorrow.”
This statement sets the stage for what promises to be a highly anticipated and potentially landmark hearing.
The Supreme Court’s decision to hear the case is a pivotal moment in Indian judicial history, especially given the political implications of the arrest of a sitting Chief Minister. The case not only involves the legal aspects of Soren’s arrest by the ED but also delves into the broader issues of political rights and the role of enforcement agencies in the democratic process.
As the nation awaits the Supreme Court’s hearing, the case of Hemant Soren versus the Enforcement Directorate has become a focal point of discussion. It raises critical questions about the balance of power between state governments and central agencies, the independence of judicial processes, and the protection of democratic institutions in India.
The outcome of this hearing could have far-reaching consequences, potentially influencing the political landscape and setting a precedent for how similar cases are handled in the future. As legal experts, politicians, and the public alike turn their attention to the Supreme Court, the words of the Chief Justice resonate, underscoring the high stakes and the charged atmosphere surrounding this landmark case.
