Madhya Pradesh: On Friday(5th April), a Special court in Gwalior, Madhya Pradesh, has issued a permanent arrest warrant against Lalu Prasad Yadav, the former Chief Minister of Bihar. This action pertains to a case alleging illegal procurement of arms and ammunition during the years 1995 to 1997.This incident has raised concerns about the veteran RJD leader’s standing in Bihar politics.
The Judicial Magistrate First Class (JMFC) Mahendra Saini, presiding over the special court designated for trials involving Members of Parliament (MPs) and Members of the Legislative Assembly (MLAs), issued this warrant.

Special public prosecutor Abhishek Mehrotra confirmed the action and detailed the charges, stating-
“The case from 1995-97 involves the acquisition of arms from an authorized dealer using forged documents. There were 23 accused in the case, registered at Inderganj police station, all of whom have been charged. Yadav has been declared an absconder.”
In light of Yadav’s absence from court proceedings, despite the seriousness of the allegations against him, the court’s decision to issue a permanent arrest warrant represents a significant development in the case.
Rakesh Pandey, a legal expert and attorney practicing at the Madhya Pradesh High Court in Jabalpur, provided insights into the ramifications of a permanent arrest warrant.
“A permanent arrest warrant is issued when the bailable, arrest, or non-bailable arrest warrants have been served, but the individual fails to appear before the court. With bailable and arrest warrants, the court specifies a timeframe for the accused to appear after issuing the orders. However, this does not apply to a permanent arrest warrant. When arrested, the accused must be brought before the court,”
-Pandey clarified, elucidating the legal procedures associated with such warrants.

Lalu Prasad Yadav was previously convicted and served time in prison in relation to the fodder scam in Bihar. However, he was granted bail in April 2021.
