New Delhi (India), February 28: The Rouse Avenue court has pronounced Aam Aadmi Party (AAP) MLA Prakash Jarwal and his associate Kapil Nagar guilty of abetting a doctor’s suicide. The court also found them culpable of criminal conspiracy and extortion and threats against the deceased, Rajender Singh.

The deceased, a doctor involved in water supply via tankers, was subjected to intimidation and extortion tactics.

Special judge M K Nagpal convicted Prakash Jarwal and Kapil Nagar for abetting suicide, extortion, attempted extortion, criminal intimidation, and criminal conspiracy for extortion.

Their conviction falls under section 506 (Criminal Intimidation) Part 2, with a maximum penalty of up to seven years.

A third accused, Harish Jarwal, faced conviction for criminal intimidation. The court upheld the prosecution’s case beyond reasonable doubt.

Additional Public Prosecutor (APP) Manish Rawat represented the Delhi police. The court ordered the accused and the prosecution to submit their affidavits, with the next hearing scheduled for March 13.

Previously, on November 11, 2021, the court had framed charges against Prakash Jarwal, Kapil Nagar, and Harish under various sections of the IPC. The charges included offenses related to extortion, criminal intimidation, and criminal conspiracy.

Background

An FIR was lodged based on a complaint dated April 18, 2020, by Hemant Singh. Singh alleged that his father, the late Rajender Singh, faced harassment from Prakash Jarwal and Kapil Nagar after Prakash Jarwal became an AAP MLA.

Prakash Jarwal, a member of the Delhi Jal Board, allegedly extorted monthly payments from Singh’s father to allow their tankers to operate. Failure to pay resulted in threats and harassment.

Despite pleas from Singh’s father, Prakash Jarwal continued the harassment, leading to financial strain and mental anguish. The exploitation and pressure ultimately led to the tragic suicide of Singh.

The court found evidence supporting Singh’s allegations, leading to the convictions.
