
The Election Commission of India (ECI) has filed an application seeking modification of an order passed by the Hon’ble Supreme Court on 11.03.2024. The ECI, through its plea, aims to clarify certain aspects of the order related to the retention of documents submitted in a sealed manner to the Court.

The application, filed under Miscellaneous Application No. 486 of 2024 in Writ Petition (Civil) No. 880 of 2017, highlights the ECI’s adherence to the Supreme Court’s directives issued on 12.04.2019 and 02.11.2023. These directives mandated the ECI to submit information and data, which was done both in sealed envelopes during court hearings and in sealed boxes in subsequent tranches.
However, a contention arises from the Supreme Court’s observation in its 11.03.2024 order, stating that copies of the statements filed by the ECI would be retained in its office. The ECI asserts that it complied with the Court’s orders by forwarding the documents received to the Court without retaining any copies, thus maintaining the confidentiality of the information.
Consequently, the ECI requests a modification of the order to rectify this observation and to return the submitted documents for compliance with the Supreme Court’s directives. Emphasizing the bona fide nature of their application, the ECI highlights the importance of justice in granting the requested relief.
In its prayer to the Hon’ble Court, the ECI respectfully seeks clarification and modification of the operative portion of the order dated 11.03.2024. Additionally, it requests the release of the documents submitted in sealed covers/boxes, pursuant to the Supreme Court’s earlier directives.
