On Wednesday (20th March): The Mumbai Court stayed the execution of a warrant against BJP MP Pragya Singh Thakur, the prime accused in the 2008 Malegaon Blast case, as she is hospitalized. The warrant was issued for her non-appearance during the trial, but Thakur’s lawyer informed the court of her hospitalization, leading to a stay on the warrant’s execution. Thakur was directed to file her hospital discharge certificate, and the court has tentatively scheduled March 27 for her to appear and record her statement.

Mumbai: On Wednesday (March 20th), the Mumbai Court stayed the execution of a bailable warrant against Pragya Singh Thakur, a Member of Parliament (MP) representing the Bharatiya Janata Party (BJP) and the prime accused in the 2008 Malegaon Blast case. The action came after Thakur informed the court about her hospitalization.

Special judge AK Lahoti had initially issued a bailable warrant against Thakur on March 11, citing her non-appearance during the ongoing trial related to the case.

Furthermore, the court had directed Thakur to present in person on March 20 and pay a fine of Rs 10,000 to annul the warrant.

On the scheduled date, Thakur’s legal counsel informed the court that the BJP MP had been admitted to a hospital in Mumbai shortly after her arrival in the city for the court appearance.

Additionally, it was revealed to the court that Thakur had not been served with the bailable warrant by the prosecution agency, the National Investigation Agency (NIA).

Consequently, the court exempted her from appearing on March 20 and postponed the execution of the warrant until her discharge from the hospital.

Judge Lahoti stated,

“The application indicates that Thakur is hospitalized upon landing at Mumbai Airport. NIA has not submitted the compliance report for the bailable warrant until 3 pm. Therefore, considering the circumstances presented in the application, the execution of the warrant is suspended until Thakur is discharged from the hospital.”

The court also instructed Thakur to furnish her hospital discharge certificate.

Previously, Judge Lahoti had instructed all the accused to be present for the recording of their statements and had warned of consequences if any failed to comply.

Thakur had been granted exemption from appearing on a prior occasion due to reported ill health but was directed to attend court on a later date, which she failed to do by March 11, leading to the issuance of the bailable warrant.

The court has tentatively scheduled March 27 for Thakur to appear and record her statement in the ongoing trial.
