The Supreme Court granted bail to activist Shoma Sen in the Bhima Koregaon violence case. Shoma Sen, along with several others, was arrested in connection with the Bhima Koregaon violence case, which dates back to January 2018

NEW DELHI: Today (5th April), the Supreme Court granted bail to Shoma Sen, a prominent Dalit and women’s rights activist, in connection with the Bhima Koregaon violence case.

The order was passed by a bench comprising Justices Aniruddha Bose and Augustine George Masih. Sen had been arrested on June 6, 2018, and made multiple unsuccessful attempts to secure bail before various courts.

Senior Advocate Anand Grover, along with advocates Nupur Kumar and Paras Nath Singh, appeared on behalf of Shoma Sen, presenting her case before the Supreme Court. Additional Solicitor General KM Nataraj represented the NIA, while advocates Siddharth Dharmadhikari and Aaditya Aniruddha Pande appeared for the State of Maharashtra.

Background:

The Bombay High Court directed Shoma Sen to approach the special NIA (National Investigation Agency) court for bail before seeking relief from the High Court. Initially, Sen had applied for bail before the Pune Sessions Court in December 2018, both before and after the filing of the chargesheet. Unfortunately, her applications were rejected by the sessions court in November 2019. Following this, the case was transferred to the NIA for investigation, and the trial was transferred to the special NIA court.

In 2020, Shoma Sen approached the High Court once again, seeking bail. However, the High Court directed her to first approach the special NIA court. Dissatisfied with this order, Sen decided to appeal to the Supreme Court against the High Court’s decision. During the proceedings, the NIA informed the apex court that it did not require further custody of Shoma Sen.
