In a recent landmark ruling, the Delhi High Court has issued an urgent directive for the Samajwadi Party (SP) to remove defamatory allegations made against Amit Malviya, the head of the Bharatiya Janata Party (BJP) IT Cell. The court’s decision came after Malviya’s legal team presented a compelling case arguing that the online accusations were causing significant harm to his reputation.
Senior Advocates Arvind Nayar and Nalik Kohli, representing Malviya, appeared before Justice Vikas Mahajan and highlighted the severe impact of the allegations. Nayar emphasized the gravity of the situation, stating,
“These kinds of statements can’t be made for anybody… It is causing damage every day. Lakhs of people have seen this.”
He urged the court to issue an interim order for the removal of the defamatory tweet, emphasizing the need for a dasti (hand-delivered) service of the court notice.
Justice Mahajan concurred with the request and ordered that the injunction be served dasti, reinforcing the seriousness of the matter.

The defamation lawsuit, filed by Malviya through advocates Surjendu Sankar Das and Annie Mittal, is rooted in a broader dispute connected to rape allegations involving an SP leader in Ayodhya, Uttar Pradesh. The case involves accusations against SP leader Moeed Khan and another individual, Raju Khan.
What is the Controversy?
The controversy intensified on August 3, when SP Chief Akhilesh Yadav tweeted a call for a DNA test to determine the truth of the allegations and suggested that if proven false, action should be taken against those involved. In response, Malviya criticized Yadav’s tweet, questioning its motives and accusing the SP of engaging in “disgusting politics.”

Malviya’s tweet included a scathing critique of the SP, asserting,
“But nothing other than this kind of disgusting politics can be expected from Akhilesh Yadav… In the coming days, wherever SP wins, there will be many news of such misdeeds against the daughters and daughters-in-law of backward society in every village. SP is less of a political party and more of a gang of criminals.”
In retaliation, the SP Media Cell posted on X (formerly Twitter), sharing images of BJP leaders with individuals accused of rape, including photos of Prime Minister Narendra Modi with Asaram Bapu (convicted of rape) and Uttar Pradesh Chief Minister Yogi Adityanath with Swami Chinmayanand (accused of rape). The post further alleged that Malviya was involved in dubious activities, including accusations of sexual misconduct.
The Delhi High Court’s decision underscores the crucial role of the judiciary in protecting individuals from defamatory online attacks and highlights the growing importance of digital platforms in contemporary legal disputes.
