Today, On 5th December, AAP MLA Naresh Balyan presented before a sessions court by the police, who requested the case be transferred to the MP-MLA court. The move aligns with jurisdictional guidelines for cases involving public representatives. Balyan is facing charges that require specialized handling under the designated court. The sessions court will decide on the transfer request in the coming days.
Delhi Police presented AAP MLA Naresh Balyan in a sessions court as part of an organized crime case, requesting his transfer to a special MP/MLA court.
This request was denied by the judge.
Additional Sessions Judge Vandana Jain to the public prosecutor stated,
“The issue before the court is that the accused person is a sitting MLA, and he needs to be produced in a special MP/MLA court,”

She added,
“I do not have the power to transfer the case. Show me the precedent.”
After the hearing resumed at approximately 1:10 PM, the judge delivered a verdict concerning former Delhi MLA Rambir Shokeen.
The judge inquired,
“As a prosecutor, you must be thorough. Are you maintaining the same stand or changing it?”
The prosecutor replied that he was relying on the judgment.
The court subsequently scheduled the matter for a ruling at 2 PM.
Naresh Balyan arrested on Wednesday in connection with an alleged organized crime case, while he had previously been granted bail in another case involving alleged extortion.
Naresh Balyan is an Indian politician associated with the Aam Aadmi Party (AAP) and currently serves as the Member of the Legislative Assembly (MLA) for the Uttam Nagar constituency in New Delhi. He was born on November 22, 1976, in Delhi and completed his education at Haryana Shakti Senior Secondary School.
In November 2024, Balyan arrested by the Crime Branch of the Delhi Police in relation to an extortion case that had been filed the previous year. His arrest followed the emergence of an audio clip that allegedly featured a conversation between him and fugitive gangster Kapil Sangwan, which gained significant attention on social media.
Following his arrest, a Delhi court placed him in police custody for two days.

The AAP condemned Balyan’s arrest labeling it “illegal” and accusing the Bharatiya Janata Party (BJP) of orchestrating a baseless conspiracy to distract from the worsening law and order situation in the capital. Balyan himself denied the extortion allegations and expressed his intention to file complaints against individuals spreading false information about him.
Balyan’s political career has been characterized by active engagement in his constituency and participation in AAP activities. However, these recent legal troubles have heightened scrutiny regarding his role and connections within Delhi’s political arena.
